Present:Councilmen George M.Mason,J.H. Wentworth,David V.Stout,Carl W.Pate. Absent:Councilme n James B.Thomas,Dale D.Daniels. This being the time specified in a legal notice calling a public hearing on the matter of rezoning from .Zone "B" to Zone "Cl" certain property on Old Gilroy Street between the east line of Alexander Street and the Guest line of Chesttnut Street the Mayor now asks if there is any person present who desires to protest and /or object to the re- zoning. No person appears to protest and /or object to the rezoning. ORDINANCE NO.499 is presented and read. Motion by Councilman Stout,seconded by Councilman Mason that ORDINANCE NO.499 be adopted. ORDINANCE NO.499 AN ORDINANCE A1.1ENDING ORDINANCE NO.422 , C0111 ONLY KNOWN AS THE "ZONING ORDINANCE" BY REZONING CERTAIN PROPERTY LOCATED ALONG OLD GILROY STREET FROTAI ZONE "B" DISTRICT TO ZONE "C -1" DISTRICT. Vote on the motion to adopt ORDINANCE NO.499: AYES: Councilmen George M.Ttlason,J.H. r'dentworth,David V.Stout, Carl W.Pate. NOES: Councilmen None ABSENT: Councilmen James B.Thomas,Dale D.Daniels. RESOLUTION X0.270 is now presented and read. The Tdayor now asks if there is any person present who desires to protest and /ot object to the granting of a Use Permit to Jehovah's Witnesses to erect a churhh building at the borthwest corner of Seventh and Chestnut streets. Mrs.Helen Garcia now appears before the Council to protest the granting of a Use Permit to Jehovah's 1.11itnesses stating that she believed that Jehovah's ?'litnesses should not be given any cansiderat ion as children of members of Jehovah's VJitnesses do not salute the Mig as other children in the mchools do. Councilman Stoutspeaks against the granting of the Use Permit stating that Jehovah's Witnesses are against organized religion. Considerable discussion follows.Councilman Pate urges that a committee of the Council be appointed by the TIayor to investigate the matter of granting a Use Permit,further. Mr.J.'K.Dugan,representing Jehovah's 1z17itnesses now appears before the Council to discuss the granting of a Use Permit to his grpup 1284 and answers several questions asked him by the Mayor and Councilman Stout. A motion by Councilman Stoutthat the matter of granting a Use Permit to Jehovah *s Witnesses to construct a church building at the northwest corner of Seventh and Chestnut Streets, be tabled failed for want of a second. The Mayor now asksthe City Attorney to study the legal aspects of the zoning ordinance with reference to denying a Use Permit and asks the Councilmen to give the matter further study, the City Attorney to report his findings to the Council 1..Zonday, October 1, 1951. The Mayor states that 1,1r.M. J. Filice is unable to be present at this meeting and the Clerk is instructed to invite him to attend the regular monthly meeting of the Council 1.1onday,October''..1,1951. Councilman Mason discusses the need for a new addressograph for use of the Water Department. Motion by Councilman Pate,seconded by Councilman Stout and carried that Councilman Mason purchase a new addressograph machine for use of the Water Department. Councilman Stout discusses the matter of changing the tower clock in the city hall building from spring operation to electric at a cost of $210.00. Motion by Councilman Mason,seconded by Councilman Pate and carried that the Buildings and Grounds Committee invest1gate the matter of changing the clock in the tourer of the City Hall building from spring operation to electric and that the - c amnittee be given author- ity to act. The Mayor now discusses the drainage problem on Miller Avenue stating that he has been informed that the County of Santa Clara wants to fight the injunction of the Stelling interests but wants the city to take the lead in this matter. It is unanimously agreed that the Council is opposed to the City taking the lead in this matter and it is their opinion that the County of Santa Clara should tale the lead.
