In the absence of His Honor Mayor George M.Mason this regular
adjourned meeting of the Common Council is called to order by the
Cit.y Clerk.
Present:Councilmen Carl W.Pate,Charles GallofJ.Hughes KenneQyt
Courtland M.Rush,Kenneth L.PetersentSegundo Sanchez.
The City Clerk now asks for nominations for Mayor pro...Tem.
Mot.ion by Councilman Kennedytseconded by Councilman Rush and
carried that Councilman Carl \f . Pate be lIayor-Pro,.t.em.
This being the time specified in a legal notice published in
the Gilroy Evening Dispatch calling a public hearing on the matter
of the rezoning of certain property located on the north side of
Leavesle,y Road and west of the west. line of Murray Avenue from
Leavesley Road to the north cit.y I1mits,the City Clerk is in-
structed by the Mayor Pro-t.am to read the report, findings and
recommendations of the City Planning Commission of the City of
Gilroy. The Clerk proceeds to read the report from the'Planning
Commission on t.he request of Be Ge Manufact.uring Company to
rezone propert.y located on the north side of Leavesley Road and
west of. the west line of Murray Avenue from Leavesley Road to the
north city limits.
Attorney Robert Byers,represent41g propert.y owners int~rested
in the proposed rezoning, is now called upon by the Mayor Pro-tam
to discuss his clients views on the proposal.
Mr. 'Snyder, representing Be Ge L..~facturing CompanYtpe;titioners
for the rezoning, is now called upon by the Mayor Pro-tem.o give
his company's views on the proposed rezoning.
Several of the property owners cvncerned in the rezoning appear
before the Council to discuss the proposed rezoning.

Motion by Councilman Sanchez, seconded by Councilman Petersen
and carried that the matter of rezoning as presented in the
recommendation of the City Planning Commission of the City of
Gilroy on the petit-ion of Be Ge Manufacturing Company be- ref-
erred back to the Planning Commission for further discussion
and that the Planning Commission be advised that the Mayor.and
Common Council would appt"eciate an invi.tation from the Coromi ssi on
to be present at this meeting.
Attorney Byers states that he will produce a "Consent of
Property Owners" if his clients ~ree to the final decision
made at the j oint meeting of the Council and the Planning
Commission.

W.J.Hanna,Jr. of the City Engineer's office,now presents plans,
and specifications for the proposed Replacement of a Portion
of the Outfall Sewer Line estimating that the enrtire cost of the
project will be $28,372.00.
RESOLUTION NO.348 is now presented and read.
Motion by Councilman Rush,seconded by Councilman Gallo that
RESOLUTION NO.348 be adopted.

RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF GILROY RES-
CINDING RESOLUTION NO. 292, PASSED AND ADOPTED BY THE COUNCIL
ON JULY6t19S!.
YHEREAS,the Common COuDcil of the City of Gilroy did:'OB
Jul,W 6,1953 adopt and pass Resolution No.292, applying for an
allotment under Chapter 2O,Statutes of 1946, in t.he amount of
$5,426.63, t.o accompany the application for said amount made
on that date to the State of California,Department of Finance,
for that certain project entitled ~Outfall Sewer Extension
and/or Replacement,Unit NO.l",and
WHEREAS,the City of Gilroy did not at that time complete
the preparation of plans and specifications or contract tor
the work,and
WHEREAS, the City of Gilroy now has additional funds tor
the proposed work, and it is desired to enlarge the scope of
the project by the preparation of a new application to "
accompany the plans and speeifications"now completed,which
will require the pass~e of a new resGlution to accompany said
application.

RESOLUTION NO.349 is now presented and read.
Motion by Councilman Sanchez, seconded by Councilman Kennedy that
RESOLUTION NO.349 be adopted.

Applyi~ for an Al10tment under Chapter 20,Statutes
of 1946.
WHEREAS, the State of California,under Chapter 20,Statutes ot
1946 (First Extra Session),as amended,has appropriated fUnds for
allotment to provide for financial assistance to Local Agencies,
defined therein as counties,c:ities and countfes,or clties,so that
they may engage in a large public works construction program in
order to prevent and alleviate unemployment; and
WHEREAS, the City of Gilroy hereinafter designated -Local
Agenc;r' desires to apply tor an allot.ment of State aid for the
construction of a public works project under said Act;and
WHEREAS, an application to the State Director of Finance for
such an al10tment has been prepared and presented to this Legi8-
lative Body for consideration;and
WHEREAS, Local Agency has made provisions for paying that portion
of the cost of the project not requested as an allotment from the
State;
NOW,THEREFORE,BE IT RESOLVED, that Local Agency submit the
aforesaid ~pplication for State aid tor construction of a public
works project to the Director of Finance,requesti~ an allotment
of Five 'lhouand Four Hundred and Twenty-six and 63/100 Dollars
($5,426.63) or an allotment of such 8Blount as may be all.oted by
the State Allocation Board;
BE IT FUffi'tfb.:R RESOLVED, that Local Agency hereby certifies
that the total estimate of cost to be paid for the construction
of OUTFALL S:EWl!lR REPLACEMENT,UNI'P NO.1 for which Local Agency is
making JiPplication under said act is Twenty-eight Thousand Three
Hundred Seventy-two and no/loo Dollars ($28,372.00);and
BE 1'1 FURTHER RESOLVED, that Local Agency hereby requests
the State to pay the state fa share ot the total actual cost of
construction of the project for which Local Agency is making
application for aid:
BE IT FURTHER RESOLVED, that for the purpose of this request
W.J.Hanna,City Engineer,3l4 First street,Gilroy, be, and he hereby
is designated as the authorized agent of Local. Agency,and is
hereby authorized and directed to sign the herein mentioned
application of Local Agency and to submit the sarne to the state
Director of Finance,together with a certified statement of the total
estimated cost to be paid for "construction of the project herein
mentioned and such other information as may be required;and said
authorized agent is further authorized and directed as resprutmt.., e
ative of Local Agency to conduct all negotations and conclude
arrangements,with wither the State Allocation BOard or the Director
of Finance,including requests for payment of the State's share of
cost of the construction of the aforementioned public works project.

Councilman Sanchez now discusses the need for a new water well
for the city and states that he has viewed the Forest Street
playgrounds as a possible site tor the well. It is unanimously
agreed that Councilman Sanchez proceed to make arrangement for a
test hole to be drilled.
Councilman Rush now discusses the matter of replacing of Charles

Platt ,fireman, due to his health. Councilman Rush states that he
has discussed the matter 'With Mr.P1att and that he,Mr~Platt,
would like to have the jOb of taking care of t.he city ,lawns and
Forest street playgrounds. It is unanimously agreed that Mr.Platt
be advised that he w1ll be welcome to make his residence at the
fire stationjthat he will have charge of the lawns and gardening
at Wheeler Auditorium,-Atkinson" Park,City Pumping Plant at
Monterey Street and I.O.O.F.Avenue, the small park Em Old Gilroy
under the
Street at 8th Street and the Forest Street Playgroundsj/that the
direction of the Chief Administrative Officer;
Clerk write a letter to Mr.Platt ,commending him for his many years
of faithful service as a fireman.
Councilman Pat.e discusses the meeting he attended with the-
Division of Highw~s with reference to the proposed freew~
between Madrone and Thomas Lane. 'Elle CouncilOJen are given maps
showing the proposed freeway and a general discussion follows.
The City Clerk states that he received a telephone call from the
Ci ty Clerk of Morgan Hill asking if the Council is sat-j..ned
with the proposed freeway and stat ingthat the City of Morgan
Hill was not satisfied and requested that if the Council was not
satisfied with the proposal could he be advised so that the two
cities could join together in their protest. No aeti.en is taken :..
