Present:Councilmen Carl Y.Pate,Charles Gallo,J.Hughes Kennedy, Courtland M.Rush,Kenneth L.Petersen,Segundo Sanchez. The Mayor now asks if all Councilmen have received copies of the minutes of the regular monthly meeting of September 6,1955 and the regular adjourned meeting of September 19,+955. All Councilmen answer in the affirmative. The Mayor now asks tf there are any errors or corrections to be made in the minutes. No errors being noted and no corrections to be made the Mayor now declares t he minutes of the regular monthly meeting of September 6, 1955 and the regular adjourned meeting of September 19,1955,approved. The City Attorney reports that he has compared the new ~reement with the county with reference to communications and the old ~ree- ment and has found them to be substantially the same. and recommends that the new agreement be signed. Councilman Pate states that he has no report to make on the Carnadero levee~ Councilman Kennedy states that the Recreati.on Committee of the Council will meet with the Parks and Recreation Commission o~ Wednesday evening.Co~ncilman Kennedy asks for and receive~nanimous approval of the Council to recommend to the Parks and Recreation Commission that no help be hired at t he Forest Str:eet playground; that the gate to the playground he reJlUJved and t..he grounds be open at all times. Councilman Pate reports that the water tank owned by the city will not fit the chassi s of the Chevrolet dump truck and that hi s 1654 .... committee would recommend that both the Ford Va dump truck and the Chevrolet dump truck be traded in on two new trucks. The Council gives its unanimous consent to the recommendation of Councilman Pate. Councilman Kennedy reports that he has had no opportunity to discuss arraugements for the Bull Sale with the Cattlemen's Association since the original meeting. WHEREAS, the proponents of said annexation have heretofore submitted tb the Boundary Commission of the County of Santa Clara a proposal for the armexation of the aforesaid territory to the said City of Gilroy,and the saod Boundary Commission has reported approving the definiteness and certainty of the boundaries of the said territory; and, WHEREAS, the proponents of the said annexation of said territory have also submitted to the City Planning Commission of the City of Gilroy a proposal for the anneaation of the aforesaid territory to the said city, and the 'said City Planning Commission has reported to the Common Council of the City of Gilroy approving and recommending the annexation of said tract; and, WHEREAS, the said -Annexation of Uninhabited Territory Act of 1939t', above referred to, requires upon the filing of such a petition a resolution Shall be adopted by the Common Council of the City of Gilroy giving notice of such proposed annexation and fixing the time and place for hearing of th~ petition therefor, when and where any person owning real property within the said property proposed to be annexed amy appear and obj ect thereto. A communication with a check in the amount of $43,.00 for a fire alarm box is presented and read from Earl W.Smith Organization;the fire alarm box to be installed in Park Meadows Subdivision when space is available on the board at the fire station. A communication is read from the Division of H~hwaysstating tbat the .SIGNAL AHEAD- sigs on the pavement north of First Street on Monterey Street will be painted the next time the crew is in Gilroy. The City Engineer's office recommends that a Resolution be pre- pared accepting all the improvements,utilities and streets,etc.in the Park Meadows Subdivision. The City Attorney presents and reads a Resolution of completion of all work in Tract NO.l046,Renz Addition. The bond and agreement between George C.Re1pz and the City of Gilroy with reference to work to be done in the Tract by the developer is presented and dis- cussed. It is unanimously agreed to withhold approval of the Res- olution until the City Attorney and the City Engineer have checked the date of acceptance of the Map of Tract 1046. The City Attorney reports on street lighting in the Renz Tract stating t.hat an assessment district will have to be formed under the 1919 act. ~ ; 1 ..... ~ j A communication is read from L.F.Richards,architect, outlining his method of arriving at costs for remodeling Wheeler Auditorium into city offices. Motion by Councilman Sanchez , seconded by Councilman Kennedy and carried t hat the Building Inspector, the City Engineer and the Chief Administrative Officer meet and make an estimate of the cost of remodeling the Wheeler Auditorium into city offices. ~ommunications are read from George C.Renz Construction Company and Mr.Ernest Hazelrigg requesting a use permit for the latter to a building on the Renz property now being used as a maintencnce l .... shop for a public garage and repair shop. This matter is referred to the City Planning Commission. Building Inspector Brown reports that all matters contained in the letter from the city's insurance carrier have been taken care of except placing tan bark under the swings at the playground and replacing the swing seats. He states the t an bark will be placed on Tuesd~,Ocbober 4,195,. Two bids are presented for planting of lawn in Oak Court Park. The Mayor now orderee the bids for planting the lawn in Oak Court 165'7 - Fark opened. Bids were as follows: C.mds Nurseries- & Flower Shop-$1263. 78; Pavilion of Flawers,Jerome Kuehling-$$798.90. Motion by Councilman Kennedy,seconded by Councilman Gallo and carried that the bid of Pavilion of Flowers of $798.00 for planting of lawn in Oak Court Park and care of lawn to and including first cutting, be accepted. Councilman Rush announces that the annual Firemen's Banquet and City Employees Banquet will be held Friday,October 14,1955, 7 o'clock P.M. at the Hotel Milias. It is announced that the contractor for the outfall sewer line is awaiting delivery of the pipe and will start as soon as pipe is avail- able. ~ The Mayor discusses the need for two new police cars. Motion by Councilman Kennedy,seconded by Councilman Gallo and carried that the Purchasing Agent prepare bids for two automobile for use of the Police Department-the automobiles to be either 1955 or 1956 models, 6 or 8 cylinder, delivery to be on or before December 1,l955; that the Finance Conuni ttee draw up the details to be included in the bid and that bids be opened at the regular meeting of the Council on November 7,1955. Reports are presented and read: County Controller-fines for the month of August,1955;Police D epartment-September,1955 report;Building Inspector report for September,1955. Application for liquor license: Manso Nakagami-retail package Off- Sale-beer and wine-895 N.Monterey Street; Maushino George and Stella Bounds,an Sale Beer,d.b.a.Old South Cafe,285 S.Monterey Street. No objection is made. Reports of City Officers are presented and read. r ' Motion by Councilman Pate, seconded by Councilman Rush and carried I I......i that reports of city officers be accepted as read and placed on file. W.J.Hanna,J r. of the City Engineers office reports on the condition of Miller Slough south of Pacheco Pass Road and states that photographs have been taken showing the condition of the channel. Councilman Sanchez reports on action taken to stop bank erosion on the property of F rank Serafin south of Pacheco Pass Road on Miller Slough. 1658 Councilman Sanches discusses the matter of providing water service for dwellings located on the west side of Forest Street north of Swanston Lane. Councilman Sanchez states that he will discuss the~ matter of financing a water line f~r these dwelli~s with interested pirties. Councilman Sanchez requests Council'a permission to of~er the property owners the water line if they will put up security ~or payment of the cost of the line. Motion by Councilman Rush,seconded by Councilman Pate that bills as presented be allowed and warrants ordered drawn on the Treasurer. Councilman Kennedy discusses the water well located on the property of Dr.Sam Teisler who resides at Fortuna,California. The well is located in the northwest section of the city. The 1fater Committee is instructed to proceed with the drawing of specifications for a new water well to be located on the Forest Street playgrounds and that bids be opened at. the regular monthly meeting of the Council on November 7,1955.
