HomeMy WebLinkAboutMinutes 1955/10/10 1658 Gilroy, California October 10,1955 This special meeting -of the Common Council, called by the Mayor, by mailing post card notices to the Mayor and Councilmen and to the press,more t han twenty-four hours in advance, is called t 0 order by His Honor Mayor George M.Mason. Present:Counci1men Charles Ballo,J.Hughes Kennedy,Courtland M. Rush,Segundo Sanchez.Absent:Councilmen Carl W.Pate,Kenneth L. Petersen. The Mayor states that the purpose of this meeting is to consider advancing the date for the pUblic hearing on the proposed Second Northern Addition. . The City Clerk presents and reads RESOLUTION NO.361. Motion by Councilman Kennedy,seconded by Councilman Rush that RESOLUTION NO.36l be adopted: RESOLUTION NO. i61 RESOLUTION RESCINDING RESOLUTION NO.36o ADOPTED OCTOBER 3,1955. WHEREAS, the Common Council of th~ City of Gilroy did heretofore and on the ~rd day of October,1955, adopt Resolution No.36o rel-. r . I I L 1659 to the proposed annexation of premises located adjacent to the northerly city limits of the C'ity of Gilroy,and designating the said land as "Second Northenr Additionll, and fixing the time and place for the hearing of the petition for the annexation of said land in the said Resolution as the 5th day of December,1955, in the Common Council Chambers,in the City Hall,Gilroy,Cal:i.fornia,at the hour of 8:00 0 'clock p.m.,and directing the City Clerk of the City of Gilroy to give notice of the time and place of hearing in accordance with law; and, . WHEREAS, it appears that the proponents of said proposed annexation desire that the time of the hearing of the petition for the said annex- ation be heard before the Common Council prior to the said 5th day of December,1955,and at the earliest time the business of the Council and the law will permit;and, WHEREAS, it appears that the proposed notice of hearing of said petition can be given if the hearing is held the 21st d~ of November, 1955, and no valid reason existing why the hearing should not be heard on said date. NCNT , THEREFORE, BE IT RESOLVED: That said Besolution No.360 hereinbefore mentioned, fixing the date of the hearing for December 5,1955, shall be, and the same is hereby rescinded. RESOLUTIQ~ NO.362 RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF GILROY PROVIDING FOR ANCYrICE OF HEARING PETITION FOR ANNEXATION OF UNINHABITED TERRITORY,DESIGNATED AS ~SECOND NORTHERN ADDITI~,TO THE CITY OF GILROY UNDER THE ANNEXATION OF UNINHABITED TERRITORY ACT OF 1939. ,",,-'" .,~ I I i U WHEREAS,a written petition has heretofore been filed in the office of the Clerk of the City of Gilroy, under the provisions of the "Annexation of Uninhabited Territory Act of 1939~, as set forth within Sections 35300 to 35325 , inclusive, of the Government Code of the State of California,asking that there be annexed to the City of Gilroy,as uninhabited territory, the following described tract of land, contiguous to the City of Gilroy city limits,situated in the County of Santa Clara, State of California, to-wit: Being a portion of Ranch Lots 24 and 25 as shown on Map No.7 acc ompanying the Final Report of the Referees in the Las Animas Rancho Partition Suit,Action No.5536 had in the Superior Court of the State of California,in and for the County of Santa Clara, and being more particularly described as follows: Beginning at the intersection of the northwesterly city limit line of the City of Gilroy with the southwesterly line of the State Highw~ (195,) and running thence along the said northwesterly City Limit line ~.70OW. 575.11 feet to an iron pipe; thence N.2l l4~. 270.90 feet to an iron pipe;thence along the line common to said Ranch Lots 24 and 25 westerly 406.37 feet to an iron pipe;thence N.l032t w. 466.48 feet to an iron pipe in the southerly line of the property of the Pentecostal Church;thence along said southerly line N.88030'50QE. 814.08 feet to a concrete monwnent in t..he southwesterly line of the State Highway;thence continuing along the 1660 projection of saids8uther~y line of the Pentecostal Church property N.88 30'50wg. to the intersection thereof with the northeasterly line of the Southern Pacific Railroad Property and the present Corporate Limi~s ot che City of Gilroy;thence along said line S.22 22t30~. to the intersection thereoT with the original northwesterly limit line of the City of GilroYithence along said line S.70OW.to the point of beg~nning. and, WHEREAS, it appears that the said petitiop has been signed by the owners of not less than one-fourth (1/4) of the land in the territory sought to be annexed and by assessed value, and that the said tract of land is contiguous to the present city limits of the said City J........,... of Gilroy;and, . WHEREAS, the proponents of said annexation have heretofore submitted to the Boundary Commission of the County of ojanta Clara a proposal for t he annexation of the aforesaid territory to the said City of Gilroy,and the said Boundary Commission has reported approving the definitemess and certainty of the boundaries of the said territory;and, WHEREAS, the proponents of the said annexation of said territory have also submitted to the City Planning Commission of. the City of Gilroy a proposal for the annexation of the aforesaid territory to the said City, and the said City Planning Commission has reported to the Common Council of the City of Gilroy approving and recommending the annexation of said tract; and, WHEREAS, the said "Annexation of Uninhabited Territory Act of 1939", above referred to, requires upon the filing of such a petition a resolution shall be adopted by the Comon Council of the City of Gilroy giving notive of such proposed annexation and fixing the time and place of hearing of the petition therefor, when and where any person owning real property within the said property proposed to be annexed may ap~ and Object thereto. NOW, fHEREFOR1!l , BE IT RESOLVED: That the Common Council of the City of Gilroy doe&f.hereby designate the said territory propsed to be annexed to the Cityof Gi~O[T a~~~NDRE:~~~AD~~Ti~N~REBY ORDERED: .,... ..1 That the 21st day of November,1955, at the hour of 8:00 0 'clock ..- p.m. of said d~, in the Common Council Chambers, in the City Hall, Gilroy,California,be, and the same is hereby fixed as the time and place for hearing of the said petition and pFoposal to annex said territory,when and where any person owning real property within such tract or otherwise having a right to protest, and having any objections ~o the proposed annexation,m~ appear before the said Common Council of the City of Gilroy and show cause,in writing,!f any he has,why said territory should not be so annexed,and the City Clerk of the City of Gilroy is hereby directed to cause a copy of this Resolution to be published at least once a week for two (2) successive weeks with the last publication completed at least twenty (20) days before the date of hearing, in the GILROY'{EVENING DISPATCH, a newspaper of general circulation published in the said City of Gilroy, and in the MORGAN HILL TIMES, a newspaper of'Egeneral circulation,published in the County of Santa Clara,but outside the city limits of the City of Gilroy.
