Present:Councilmen Carl W.Pate,J.Hughes Kennedy,Courtland M. Rush,Kenneth L.Petersen,Segundo Sanchez. Absent:Councilman C'harles Gallo. This being t,he time specified in a legal notice published in the Gilroy Dispatch and the Morgan Hill Times calling a hearing on the proposed annexation of the Second Northern Add~tion,the Mayor now asks the City Clerk to read the report of the City Planning Commission of the City of Gilroy on the proposed annex- $ ation of the Second Northern Addition. The Mayor now asks if any written protests have been filed against the proposed annexation. The Clerk states that no written protests have been filed in his office. The Mayor now asks if t here is anyone present who desires to s~eak for or against the proposed annexation. No person appears to speak for or against the proposed annexation. I I.",.... Motion by Councilman Sanchez, seconded by Councilman Pate and carried that the Ordinance annexing the Second Northern Additi,on to the City of o~ Gilroy be read. The City Attorney presents and reads <RDINANCE NO.536. Motion by Coubcilman Sanches,seconded by Councilaan Pate that ORDINANCE NO.536 be adopted: ORDINANCE No.516 AN ORDINANCE PROVIDING FOR THE ALTERATIONS OF THE BOIDIDARIES OF THE CITY OF GILROY BY THE ANNEXATION THERETO OF CERTAIN UNINHABITED TERRITORY,TO BE KNavN AS .SECOND NCRTHERN ADDITIbr,TOTHE CITY OF GILROY,AND FOR THE INCORPORATION OF SUCH ANNEXED TERRITORY IN ANB AS A PART OF sum ImNICIPALITY FOR T HE GOVERNMENT AND MUNICIPAL CONTROL OF SUCH ANNEXED TERRITORY. Vote on the motion to adopt ORDINANCE NO.536: AYES: NOES: ABSENT : Councilmen Pate,Kennedy,Rush,Petersen,Sanchez Councilmen None Councilman Gallo. Mr.Sam Gurgiolo,a resident of Miller Avenue, now appears before the Council to discuss the matter of drainage in t he area along Miller Avenue and west of Miller Avenue particularly with respect to two culverts that have been placed by the city across ~he alley on Fourth Street west of Miller Avenue. After some discussion it is agreed by Mr.Gurgiolo and the Council that the culverts remain in place and "see what happens". Walter Hanna,Jr. of the City Engineers office, now appears before the Council on behal~ of Gilroy Motor Company and Etalo Canepa, owners of property in the Second Northern Addition,both of whom are present,to in~uire if the city intends to instal the sewer and water mains in the newly annexed area or should the property owners have the work done under contract. It is unanimously agreed that the property 0 wners should have the work done by contract but that all work would be done according to city specifications and under city supervision. Councilman Pate announces that he and City Administrator Cox would attend the meeting of the Joint Interim Committee on Transporation Problems to be held in Oakland on November 28th. The City Attorney presents and reads nESOLUTION NO.365. Motion cry Councilman Kennedy,seconded by Councilman Rush that RESOLUTICN NO.365 be adopted. RESOLUTION NO. i65 RESOLUTION DETERMINING THAT AGREEMENT MADE WITH HENRY A.SMITH BY THE CITY OF GILROY,RELATIVE TO PARK MEADcmS UNIT #l,HAS BEEN COMIJLIED WITH BY SAID HENRYA.SMITH,AND TERMINATING HIS LIABILITY. 1670 WHEREAS,HENRY A.SMITH did heretofore enter into an agreement with the City of Gilroy on the 8th d~ of June,1954, by which he, as the owner and subdivider of a tract of land designated as PARK MEADOWS, UNIT #1, agreed to furnish and install sewer and water mains, to grade,gravel and oil streets and alleys,construct sidewalks,curbs and gutters,furnish and install fire hydrants and fire boxes and electroliers,all to the satisfaction of the Common Council of the City of Gilroy,in the said subdivision,and to furnish a bond in the sum of $15,000. to be conditioned upon the fai thfulpe-rformance of the said agreement,in order to secure the approval of the said Common Council to the plat or map of the said subdivision,and WHEREAS, the said HENRY A.SMITH has fully performed all of the conditions,covenents and ~reements contained in the. atorasaid~agree- ment ,with t he exceptions of t he installation If fire alarm boxes, which cannot be installed at ~his time because of the lack of space on t he board at the firehouse, and WHEREAS, the said HENRY A.SMITH has paid to the City of Gilroy the sum of $435.00,which it is estimated is the amount which it will cost to furnish and install the fire alarm boxes called for by the said agreement,and _ WHEREAS, the Common Council of the City of G1lroy does no" find that there us nothing further to be done by the said HENRY A.SMITH under the terms of the said agreement,and his liability thereunder should be terminated and ended and the bond heretofore given on his behalf by the PHOHNIX INSURANCE COMPANY Should be terminated and the liability of the bondsman thereunder declared ended, NON,THEREFORE, be it resolved by the Mayor and the Common Council of the City of Gilroy that the said HENRY A.SMITHhas fUlly complied with all of the provisions of the aforesaid ~reement and that he has no liability thereunder and that the said PHOENIX INSURANCE COMPANY be discharged of'all obligations arising out of the execution of the aforesaid bond. It is unanimously agreed that the Buildings and' Grounds chairman and the Building Inspector make a thorough inspection of the dwell- ing and report their findings to the Council;also secure the cost of painting the club Douse.
