This regular monthly meeting o~ the Common Council is called to order
by His H~or M~or George M.Mason.
Prese~:Councilmen Carl W.Pate,J.Hughes Kennedy,Courtland M.Rush,
Kenneth L.l?e'tersen,Segundo Sanchez. Absent:Councilman Charles Gallo.
The Mayor now asks if' all Councilmen have received copies of' the
minutes of' the regular monthly meeting November 7th and the regular
adjourned meeting of' November 21,1955.
All Councilmen answer in the af'firmative.
The Mayor now asks if there are any errors or corrections to be made
in the minutes.
No errors being noted and no corrections to be made the Mayor now
declares the minutes of the regular monthly meeting of November 7th
and the regular adjourned meeting of November 21,1955,approved.
This being the time specified in notices calling for bids to furnish
the gasoline for the city f'or 1956 which were mailed to all local oil
dealers the M~or now orders the Clerk to proceed with theropening of
the bids.
The following bidS are submitted and read: Shell Oil Company-26.1 cents;:
_4 General Petroleum Corporation-24.8 cents (rider attached);Seaside Oil
Company-25.5 cents (rider attached); Tide Water Associated Oil Company-
25.9 cents;Union Oil Company-26.6 cents;Standard Oil Company-26.6 cents;
Richfield Oil Corporation-25.6 cents (rider attached);Signal Oil Company-
26.1 cents (rider attached).
Motion by Councilman Pate,seconded by Councilman Petersen and carried
that the bids for furnishing the city's gasoline supplies for the year

1956 be referred to tre Finance/the City Administrator and the City
Attorney, that the low bidder be awarded the city's gasoline business
for 1956 and that the Finance Committee chairman report the awarding of
the bid at the next regular monthly meeting of the Council.
Councilman Pate reports that his recommendation for the expenditure
of' Chapter 1890 Funds,1955 session of the Legislatupe ,for engineering
aPd administering of ~treet work in the amount of $2,000.00 be left
to the discretion of the Superintendent of Public Works,the City
Administrator and the Street Committee.
Councilman Pate reports that he and the City Administrator attended
the meeting in Oakland of the Joint Interim Committee on Transportation
Problems on November 28,1955 and reviews the highlights of the meeting.

Councilman Kennedy reports on the care takers dwelling at Ousley
Park and estimates that it will cost $3,035.00 to ~enovate the
building. The possibility of obtaining acdwelJ.ing from the Uvas
Dam site is discussed. W.J.HannaiJr. of the City Engineer's office
states that he will furnish a set of plans for a new dwelling :free
of charge. It is unanimously agreed to investigate this matter
further and secure other cost figures for comparison.
The City Attorney discusses the matter of acceptance of the
Renz Addition and cancellation of the bond, and states he has a

Resolution prepared to release the bond.
Motion by Councilman Pate,seconded by Councilman Petersen and
carried t hat the City Attorney present and read the Resolution
he has prepared to release the bond of George C.Renz on the Renz
Addition.
The City Attorney presents and reads RESOLUTION NO.366.
Motion by Councilman Kennedy,secanded by Councilman RuSh that

V.~S,the Common Council of the C~ty of Gilroy has heretofore
approved the plat and map of the aubdivisi~ o-r certain property ~
within the City of Gilroy owned by GEORGE C.RENZ,and known and
designated as "Tract No.1046 Renz Addition" ,upon the condition [1
that the said George C.Renz should furnish and install certain
improvements therein including the grading and oiling o~ streets
and alleys ,and the construct,ion of sidewalks , curbs and gutters in
accordance with the requirements of the City of Gilroy,and the
said George C.Renz did enter into a written contract with the City
of Gilroy to furnish or cause to be furnished the said improvements;
and,
WHEREAS,the said George C.Renz was also required to firnish,and
did furnish before the approval of the said map and plat of the
subdivision, a bond in favor of the said City of Gilroy,executed
by the United Paci fi c Insurance Company, in the penal sum &f
$15,000.00, conditioned upon the furnishing and installation of
sewer and water mains,grading,gravelling,and oiling streets and
alleys,and the construction and installation of sidewalks,curbs,
~d gutters;and,
WHEREAS, the said George C.Renz has fully complied with all
provisions and conditions set forth in said bond,and there is no
longer any liability existing on the part of said bonding company.
NOW, THEREFORE, BE IT RESOLVED:
That the conditions as set forth in t he said bond,and upon which
the said bond has been given, have been perfonned ~d completed,and

to City, HaJ.1 purposes be ,discussed and t.he City Clerk presents a f'loor
plan showing the location and size of the several offices.
After some discussion it is unanimously agreed to turn over the floor
plan,as presented,to the City Engineer for the purpose of obtaining
cossts for the conversion.
A communication is read from the National Guard requesting free use
of Wheeler Auditorium for a dance on February 4,1955.
Motion by Councilman RUsh,seconded by Councilman Petersen and carried
that the National Guard be granted free use of Wheeler Auditorium f~r
a dance on lI'ebruary 4,1955.
A communication is read from the Music Department of Gilroy High
School requesting free use of Wheeler Auditorium December:: 19th and
20th,1955 for the annual free Christmas program.
Motion by Councilman tennedy,seconded by Councilman Petersen and
carried that the Music Department of Gilroy High School be granted
free use of ~~eeler Auditorium 6.n December 19th and 20th,1955 ,for
titeir annual free Chri stmas program.
A communication is read from the Public Utilities Commission with
reference to crossing signals at Ninth Street creasing. The Clerk is
instructed to advise the Commission that the City was not prepared to
furnish fifty per cent of the cost of the signals and the Council still
feels that the railroad company should bear the entire cost of the
furnishing and installation of the signals.
A communication ~s read from the Brotherhood of Locomotive Engineers
calling the Council's attention to the danger in the Leavesley Road
and Casey Street railroad crossings and requesting that the Council
take the necessary action to close Casey Street crossing.
It is unanimously agreed to advise the Engineers that the Council
sympathizes with their problem at these two crossings but the Council,
in view of' possible industrial development at Wheeler Field, does not
feel that the Casey Street crossing should be closed.
Motion by Councilman P ate,seconded by Councilman Kennedy and carried
that each city employee be given a Chri~as gift of $10.00 in cash.
Motion by Councilman Petersen, seconded by Councilman Sanchez and
carried that the sum of $16,000.00 be transferred from the Reserve
Fund to the General Fund.
Superintendent of Public Works Brown reports on progress being made
in the development of the parkingl lot on North Railroad Street.
The City Attorney states that he has prepared a resolution with

reference to the acceptance by the City of the '1954 franchise tax
payment by the Pacific Gas and Electric Company.
Motion by Councilman Pate,seconded by Councilman Petersen and

RESOLUTION AUTHORIZING ACCEPT .>\NCE OF AMOUNT OFFERED BY PACIFIC J.....
GAS & ELECTRIC COMPANY IN THE PAYMENT OF FRANCHISE TAX, WITHOUT ...
PREJUDICE TO THE RIGHTS OF THE CITY OF GILROY.
WHEREAS, the City of Gilroy has heretofore granted two (2)
franchises to the COAST COUNTIES GAS & ELECTRIC COMPANY,one
giving the right to furnish gas to the inhabitants of the said
City of Gilroy,and the other to furnish electricity thereto,under
an agreement and ordinance providing for the payment of two (2$)
per cent of the gross annual receipts arising from the sale of gas
and from the sale of electricity within the limits of the City of
Gilroy;and,
WHEREAS, the said COAST COm'ITIES GAS & ELECTRIC COMPANY has been
operating under the said franchises since the year 1947,and did
pay the said percent~e as long as it was the owner and holder of
said franchises;and,
WHEREAS, the said COAST COUNTIES GAS & ELECTRIC CIDMPANY has
marged with and become a part of the PACIFIC GAS & ELECTRIC COMPANY,
and the said PACIFIC GAS & ELECTRIC COMPANY is now the. owner and
holder of said franchises;and,
WHEREAS, the said PACIFIC GAS & ELECTRIC COMPANY now disputes thet
the legality of the said franchises and ,the requirement that it pay
2% of the gross annual receipts from the sales of gas and' ele ctric-
ity within the said city limits,and a controversy exists betw~en
the said City of Gilroy and the said Pacific Gas & Electric Company
relative to the validity of said franchises;and, j.........
lIHEREAS,the said PACIFIC GAS & ELECTRIC COMPANY has of:rered to .
pay to the. City of Gilroy for the year 1954, the sum of $3163.24
on the gas franchise, and the sum of $4315.23 0>> the electricity
franchise,without prejudice to the rights of the said City to
challenge the sufficiency of t he same,and upon the understanding
that the acceptance of the said payments will not constitute a
waiver of any of the rights of the City of Gilroy whatsoever as
to the sufficiency of the payments,and that the City shall retain
all rights which it would possess were it not to accept said pay-
ments.
NOW,THEREFORE,BE RESOLVED:
That the said City of Gilroy accept the said.:payments under the
conditions which they have been offered,and that in such accept-
~~ce the City of Gilroy does not waive any rights whatsoever of
any kind.

Councilman Pate advises the Council that he has looked at a truck
in the Division of Highways Mainrenance yard at Oakland and believes
the city should put in a bid for the vehicle. It is unanimously
agreed that Councilman Pate contact the proper authori tie s to find
out if the truck can be purchased.
Councilman Pate discusses the matter of street department picking
up grass and leaves from gutters in the residential area. It is

unanimously agreed that the street department should pick up all
leaves,grass trimmings,etc. from the gutters in the residential area
but any glas,bottles and refuse of this nature should not be picked up
by the department.
Councilmari Pate recommends that red lights should be placed on the
street department trucks and the street sweeper. The investigation of
this matter is left in t he hands of Superintendent of Public Works.
: The Mayor announces that he has appointed the Recreation Committee of

the Council to represent the Council on the committee made up of
"Recreation Commission and schoQl board representatives to discuss the
recreation program for the city'.

A communication is read from the City Engineer recommending payment
for work on the Outfall Sewer line.
Motion by Councilman Sanchez,seconded by Councilman Petersen and
carried that the recommendation oC the City Engineer be accepted and
Granite Construction Company be paid the sum of $3458.35 and that the
sum of $2561.74 be paid in thirty-five days.
A communication.is read from the City Engineer recommending payment
of $1267.05 to Leo Piazza Paving Company for work completed on South
Alexander Street.
Motion by Councilman Pate,seconded by Councilman Kennedy and carried
that the repommendation of the City Engineer be accepted and that Leo
Piazza Paving Company be paid the s~ of $1267.05 for work completed
on South Alexander Street,that before t he final payment is made a final
inspection shall be made.
Reports of the County Controller,the Building Inspector,Gilroy Police
Department and the poundmaster are presented and read and ordered filed.
Reports of the "City Officers are presented and read.
Motion by Councilman Pate, seconded by Councilman Rush and carried that
the reports of City Officers be accepted as read and placed on file.
Th'e Mayor now discusses the condition of the "GILRoy't signs at the
north aneT south entrance s to the city.
Motion by Councilman Pate, seconded by Councilman Rush and carried
that the contract with Electrical Products Corporation,owner of the
nGILRO~' signs at the north and south entrances to the city, be can-

celled.
Motion by Councilman Rush,seconded by eouncilman Kennedy and carried
that bills as presented be allowed and warrants ordered drawn on the
Treasurer.
