Pate act as Mayor Protem. This regular monthly meeting or the Common Council is called to order by His Honor Carl W. Pate, Mayor Protem. Present: Councilman Courtland M. Rush, Kenneth L. Petersen, Everett C. Wentworth, Charles Gallo, and Sig Sanchez. Absent: Mayor George C. Milias. The Mayor Protem asks ir all Councilmen have received copies or the minutes of the regular monthly meeting of February )rd and the regular adjourned meeting of February 18th. All Councilmen answer in the afrirmative. The Mayor Protem now asks ir there are any errors or omissions in the minutes as presented. No errors or omissions are noted. The Mayor Protem now declares the minutes of the regular month my meeting of February )rd and the regular adjourned meeting of February 18, 1958, approved. The Mayor now arrives and takes his place at the Council table. A letter rrom W. J. Hanna is read stating his findings in his investigation made of the Building Code in regard to the problem presented by Mr. M. J. Filice ror the proposed construction or a building on the property between the Richfield and Union Oil Ser- vice Stations on North Monterey Street. Mr. M. J. Filice comes before the Council and states that he is confused about the build- ing restrictions on this property where he proposes to build a Medical and Dental building. Mr. Filice requests that the Council consider changing the fire zone and also that the Council adopt the 1958 Building Code. Councilmen Petersen and Rush state that 1898 the Council should adopt the 1958 Uniform Building Code. The City Attorney is instructed to check into the matter further and report back to the Council. The Mayor now asks that the bids for alterations at the Wheeler Auditorium for the new city offices be read. The bids are opened and read as follows: Gordon E. Farottee - For all work and materials listed in Special Provisions and shown on plans $5122.00, Alternate #1 for moving electrical panel and hot air riser addi -569.00, Alternate #2 for aluminum awnings add $602.00, Alternate .., 3 for insulation add $269.00; Nelson Construction Company -4348.00, Alternate #1 1575.00, Alternate #2 $290.00.~ Alternate ..3 #325.00; Wm. Radtke & Son - $4990.00, Alternate ffl $668.00, Alternate #2 $998.00, Alternate #3 $285.00; Geo. C. Renz Construction Company $4800.00, Alternate #1 $640.00, Alter- nate #2 $925.00, Alternate #3 $3600.00. Mr. Nelson of the Nelson Construction Company appears before the Council asking that he have the opportunity to reconsi- der his bid for aluminum awnings since no specifications were ~iven. Motion by Councilman Pate SEcond by Councilman Gallo and carried on recommendation of the City Attorney, that the bids be held until March 17th, for the committee to discuss the alter- nates with Nelson Construction Company and report back to the Council at the regular adjourned eouncil meeting. The Mayor now calls for the new lease and the Resolu- tion authorizing the execution of the lease between the City of Gilroy and the National Guard for portions of Wheeler Auditorium. Resolution No. 460 is presented and read by the City Attorney. The City Attorney also explains the provisions of the new lease. Motion by Councilman Petersen second by Councilman Wentworth that Resolution No. 460 be adopted. RESOLUTION NO. 460 J BE IT RESOLVED that the City of Gilroy enter into a written lease with the State of California wherein the City of Gilroy J shall rent to the State of California, and the State of California shall lease from the City of Gilroy, the same premises described · . in that certain lease dated the 27th day of October, 1944 cover- ing portions of the Armory or Wheeler Auditorium Building sitiuated on the south side of Sixth Street between Church and Rosanna Streets, and upon the same terms and conditions set forth in said lease. Hanna & Sons to the Public Utilities Commission requesting the crossing at Baines Lane be closed is J read and permission is requested by Mr. Hanna Jr. to send the i letter to the Public Utilities Commission. Councilman Pate sug- gests that this crossing be closed. The Attorney states that .. first the deeds to the City for Alexander Street Should be accept- ed by resolution. Resolution No. 461 is presented by the City Attorney. Motion by Councilman Pate second by Councilman Gallo that Resolution No. 461 be adopted. RESOLUTION NO. 461 BE IT RESOLVED that the City of Gilroy accepts the follow- ing conveyances or grants: Deed dated March 21, 1956 to City of Gilroy from Gilroy Telephone Company. 1899 [ Deed dated May 10, 1956 to City of Gilroy from Henry Brem and Sarah E. Brem, his wife, and George Brem and Sarah A. Brem, his wife. MQtion by Councilman Pate second by Councilman Wentworth that Walter Hanna Jr. be authorized to send the letter to the Public Utilities Commission. A letter from the Associated Consultants is read Dffering to conduct recruiting and selection procedures to fill the posi- tions of Director of Public Works and Administrative Assistant for the sum of $250.00 plus an amount not in excess of $50.00 for advertising, printing, etc., the work to cover a period of three or four months. Motion by Councilman Sanchez second by Councilman Petersen and carried that the City of Gilroy grant permission to the Associated Consultants to conduct recruiting and selection pro- ced~res for $250.00 to fill the positions of Director of Public Works and Administrative Assistant plus an amount not to ex- ceed $50.00 for advertising & printing services, etc. A communication from the Gilroy Evening Dispatch is read reporting that they have received many complaints from paper route boys and subscribers concerning dogs running at large. A representative from the Dispatch at this time comes before the Council stating that he would like the Poundmaster to try to catch these dogs. The City Administrator is instructed to give Bert Weiss, Poundmaster instructions to pick up all dogs running at large. The Cit, Admininstrator is also instructed to write a letter to Mr. Turner of the County Health Department to see what further can be done about the dog problem. Mr. Nelson from the Nelson Construction Company requests the Council to award the bid tonight for alterations at the Wheeler Auditorium. Motion by Councilman Pate second by Councilman Gallo and carried to withdraw their previous motion to hold the bids until March 17th. Motion by Councilman Pate second by Councilman Gallo and carried that the bid for the alterations at Wheeler Auditorium for the new city offices, be awarded to Nelson Construction Company for $4348.00 and that the alternates be discussed at a later date. A letter from the Gilroy Public Schools is read requesting use of Wheeler Auditorium for graduation exercises. Motion by Councilman Petersen second by Councilman Rush and carried that the Elementary School on June 17th and the High School on June 18th be granted permission to use Wheeler Auditorium free of charge. At this time there is a hearing on the rezoning of certain o -....; I . 1900 property north and south of I.O.O.F. Avenue fran "En to "B" Dis- trict. The Mayor asks if there are any protests. There are none. The City Attorney presents and reads Ordinance No. 566. Motion by Councilman Sanchez second by Councilman Gallo that Ordinance No. 566 be adopted. ORDINANCE NO. 566 AN ORDINANCE AMENDING ORDINANCE NO. 422, OF THE CITY OF GILROY BY REZONING TERRITORY FROM ZONE "Ett DISTRICT TO ZONE "B" OISTRICT. Carr City Clerk Motion by Councilman Sanchez second by Councilman Pate and carried that the City Administrator be authorized to advertise for bids for both six and eight cylinder police cars. Reports on water samples taken by the Santa Clara County Health Department on February 13th and 20th are read. These reports are satisfactory and are ordered filed. Motion by Councilman Pate second by Councilman Wentworth and carried that the 5% salary raise from July 1, 1957 to March 1, 195$ to City employees be~granted and that the City Clerk be authorized to draw the warrants. Councilman Wentworth reports that the Sewer Committee recom- mends that the request for the raise in garbage rates be allowed according to the schedules set forth by the City Administrator. Motion by Councilman Wentworth second by Councilman Petersen and carried that the raise in garbage rates be granted and that the City Attorney draw an ordinance setting forth the accepted rates. This matter is referred to the City Attorney for further study. Councilman Sanchez states that the City Engineer be instructed to proceed with the plans and specifications on the Uvas pipe line project. The Mayor instructs the City Engineer to proceed with the plans. Counbilman Petersen reports that curging on the Miller and Lux property should be installed. Councilman Pate states that Jermme Kuehling has offeredhhis services to the City to prepare a land- scape plan for the proposed park, and that the curb should not ., be laid until the plan is submitted. All Councilmen accept Mr. U Kuehlings offer to submit a plan for landscaping the park. The report of the Police Department is presented and read. Motion by Councilman Petersen second by Councilman Wentworth and carried that this report be accept as read. Reports of the City officers are presented and read. Motion by Councilman Pate second by Councilman Wentworth and carried that the reports of the City Officers be accepted as read and placed on file. Motion by Councilman Pate second by Councilman Petersen and carried that bills as presented be allowed and warrants ordered 190B drawn on the Treasurer. Motion by Councilman Pate second by Councilman Gallo and carried that this meeting be adjourn to Monday, March 17, 1958, at 8 o'clock p.m., Council Chambers, City Hall, Gilroy, Cali'f9rnia.
