This regular monthly meeting of the Common Council is
called to order by His Honor George C. Milias.
Present: Councilmen Carl W. Pate, Courtland M. Rush,
Kenneth L. Petersen, Everett C. Wentworth, Charles Gallo, and
Sig Sanchez.
The Mayor now asks if all Councilmen have received copies of the
minutes of the regular monthly meeting of April 7th, the special meeting
of April 16th, and the regular adjourned meeting of April 21st.
All Councilmen answer in the affirmative.
The Mayor now asks if there are any errors or omissions in the
minutes as presented.
No errors or omissions are noted.
The Mayor now declares the minutes of the regular monthly meeting
of April 7th, the special meeting. of April 16th, and the regular adjourned
meeting of April 21, 1958 approved.
A letter from the Citizens Committee for County Progress is read re-
questing the Council to endorse County Bond measures. The Clerk is instruc-
ted to notify Gavin Cullen, General Chairman that the Council does not wish
to endorse the County bond measures recause it relieves that this matter
should be decided by individual citizens. The Clerk was also directed to
inform the Citizens Committee that the street signal standards could not be
used for publicising the measures because the State does not allow any
signs to be placed on them. .
A letter is read from the Board of Supervisors requesting the attendance
of the Mayor at a City Selection Co~~ittee on May 12th at 3:00 p.m. The
~layor states that he will attend the meeting as requested.
Claims against the City of Gilroy for damage to real and personal
property caused by the flood on Forest Street and t.,Ialnut Lane are read from
the following: Eugene C. Huoio at 313 Walnut Lane for $7746.80, R. Tremb-
lay at 334 Walnut Lane for $7818.00, Dewey E. and Hazel A. Hewell at 333
'Walnut Lane for $7342.50, Howard F. and Patricia A. Smith at 343 Halnut Lane
for tl4257.80, John D. and Josyphine L. Jones at 340 N. Forest Street for
$8714.25" Don Martin at 324 Walnut Lane for $9111.00, Mrs. Siguel Delgado
at 330 N. Forest Street for $10982.60, William R. Platt at 323 Walnut Lane
for $8082.00, Mercedes Miranda at 353 Walnut Lane for $9240.00, Patricia A.
Smith for Edith G. O'Rourke at 363 Walnut for $6200.00, and Charles Parker
at 312 Walnut Lane for $11177.90. Motion by Councilman Rush second by
Councilman Wentworth and carried that these claims be rejected on recommen-
dation of the City Attorney.
A letter from the National Guard is read requesting the signing of an
agreement to cancel the old 1e~se on Wheeler Auditorium.
Resolution No. 467 is presented and read. Motion by Councilmn
Sanchez second by Councilman Pate that Resolution No. 467 be adopted.

RESOLUTION CANCELLING AND TERMINATING LEASE AGREEMENT COVERING ARMORY WITH
STATE OF CALIFORNIA, DATED OCTOPER 27, 1944 AND EXTENSIONS THEREOF.

The Mayor now appoints Councilman Wentworth Inspector and Councilmen
Petersen and Rush Clerks for canvassing the ballots and the absentee ballots
cast at the regular municipal election held May 5, 1958.
The City Attorney now announces that he has completed the totalling
of the votes cast in the regular municipal election of Hay 5, 1958 and pre-
sents and reads Resolution Hol 468. Motion by Councilman Pate second by
Councilman Petersen that Resolution No. 468 be adopted.

RESOLUTION AND ORDER CANVASSING VOTES CAS'r AT REGULAR
MUNICIPAL ELECTION HELD MAY 5, 1958, AND DETERMINING TOTAL
VOTE, AND DECLARING ELECTION OF OFFICERS OF THE CITY OF
GILROY.
WMEREAS, the regular municipal election for the municipal
offices of the City of Gilroy was held in said City of Gilroy
on the 5 day of May, 1958, in accordance with the provisions
of the City Charter, and purSuant to law and to due and legal
notice given of said election: and
WHEREAS, all of the absentee ballots applied for at said
election have been voted and returned to the City Clerk: and
WHEREAS, the Common Council of the 'City of Gilroy has on
the 6 day of May, 1958, canvassed the returns of said election
including the absentee votes, and found and ascertained that
the total number of votes, excluding absentee votes, cast at
said election was 1516 that the number of votes cast at
Princinct "A" was 391 that the number of votes cast at
princinct "B" was 487 that the number of votes cast at
Princinct "c" was 347 that the number of votes cast at
Princinct "D" was 291 : and
WHEREAS, the said Common Council of the City of Gilroy did
proceed to also canvass the absentee ballots cast at said
election and found and ascertained that the total number of
absentee ballots issued for said election was 10 and that
all of said absentee ballots have been returned or received: that
the total number of absentee votes cast at said election was
10 that the total number of votes, including absentee
votes, was 1526, and that the following named persons received
the total number of votes, exclusive of absentee votes, the
number of absentee votes, and the total number of votes set
opposite their respective names for the respective offices
for which they were candidates, to wit:

WHEREAS, it appears from the said canvass and the records
of said Common Council of the City of Gilroy' that all of the
above candidates were duly nominated to the respective offices
for which they were candidates, and that the said SIG SANCHEZ
received the majority of all votes cast for the office
of Mayor of the City of Gilroy; that G. B. CARR received the
majority of all votes cast for the office of City Clerk of the
City of Gilroy; that H. R. ESCHENBURG received the majority of

all votes cast for the office of City Treasurer of the city
of Gilroy; that HAROLD STURLA received the majority of all
votes cast for the office of City Marshall of the City of Gilroy,
and that CARL W. PATE, CHARLES GALLO, COURTLAND M. RUSH, KENNETH
L. PETERSEN, WILFORD E. JORDAN, and EVERETT WENTWORTH received the
majority of all votes cast for the offices of Councilmen of the
City of Gilroy.
It is, therefore, ORDERED and DECLARED that SIG SANCHEZ
has been and is duly elected to the office of Mayor of the City
of Gilroy; that G. B. CARR has been and is duly elected to the
office of City Clerk of the Cit'l of Gilroy; that H. R. ESCHENBURG
has been and is duly elected to the office of City Treasurer
of the City of Gilroy; that'HAROLD STURLA'has been and is duly
elected to the office of City Marshall of the City of Gilroy,
and that CARL W. PATE, ChARLES GALLO, COURTLAND M. RUSH, KENNETH
L. PETERSEN, WILFORD E. JORDAN AND EVERETT WENTWORTH have been
and are duly elected to the offices of Councilmen of the City
of Gilroy.
BE IT FURTHER RESOLVED:
That the City CJerk of the City of Gilroy immediately sign
and deliver to each person so elected a certificate of election.

Councilnan Pate now reads a report from W. J . Hahna Jr. for three
proposal cost estimates for paving Murray, A venue from Lea vesley Road to
I. O. o. F. Avenue. Proposal 1 for subgrade preparation, application of
two inches of crusher run base rock, and surfacing with a single seal coat:
$3000.00; Proposal 2 for subgrade preparation, surfacing with twenty-four
feet width, one and one half inches thick, plant mix pavement, with crusher
run shoulders and seal coat on shoulders: $4060.00; Proposal 3 for sub-
grade preparation and surfacing with one and one half inches of plant mix
surfacing thirty feet in width:$4925.00. It is recomnended by Councilman
Pate that this matter be referred to the Street Committee for study.
Requests from property owners fro cost estimates for the installa-
tion of sewer and water mains in the Fourth Western Addition is discussed.
Councilman Petersen suggests that this matter be referred to the City
Engineer for preparing cost estimates and presenting these costs to the
property O'WIlers. The manner of reim hlrsing the City for the work is dis-
cussed. The matter is referred to the Director of Public Works who is to
work with the City Engineer in obtaining the required information.
The Mayor asks for a report from the Street and Finance Comnittees
on the proposed purchase of a street sweeper. Councilman Pate reports that
the City is not in a position to purchase a street sweeper at the present
time but that this item should be included in the new 1958-59 budget.
Director of Public Works, Max Kludt, reports on the meeting in San
Jose regarding flood ,daJ1lalge" to the Levee on Llagas Creek. He reports
that our application for repairs to be made to the levee by the U. S.
Army engineers has been oorrectly made un:ler Public Law No. 99.
The City Clerk presents and reada a list prepared by Water Collector,
Dorothy Goodwin, of uncollectible water accounts from May 1, 1957 to Ma~l,
1958, and requests permission to write off these accounts from the water
department records. The report shows the sum of $146.70 oweing and deposits
on these accounts in the amount of $143.00, leaving a net loss of $3.60.
Motion by Councilman Pate second by Councilman Rush and carried that un-
collectible accounts of the water department in the amount of $146.70 be
written off.
Motion by Councilman Rush second by Councilman Petersen and carried
that the election boards for the general municipal election of May 5, 1958,
be paid the sum of $300.00 for their services.
An application from Dan Ruiz at the Post Office Market is read for
the transfer of off-sale liquor license. The application is ordered filed.
Reports on water samples taken by the Santa Cl~ra County Health
Department on April 17th and Hay 1st are read. The report on April 17th
shows contamination but the recheck on May 1st is satisfactory and the
reports are ordered filed.
Reports of the Police Department and Poundmaster are presented and
read. Motion by Councilman Petersen second b.Y Councilrran Sanchez and carried
that these reports be accepted as read. .
Reports of the City Officers are presented and read. Motion b,y Council-
Sanchez second by Councilman Gallo and carried that the reports of the City
Officers be accepted as read and placed on file.
The City Attorney reports that he has a resolution ready which would
quit claim a right of the City to nood certain property now belonging to Ed
Kennedy on the south side of Hecker Pass Highway with water from the City
Reservoir. The request for this action by the Council was made previously
by Mr. Kennedy. Councilman Petersen, Chairman of the Building and Grounds
Committee, is instructed to study this matter and report to the Council on
his findings.
Motion by Councilrran Pate second by Councilman Wentworth and carried
that bills as presented 00 allowed and warrants ordered dra'WIl on the Treasurer.
The third quarterly report of the audit from Logan and Frazer is pre-
sented. Motion by Councilman Sanchez second by Councilman Gallo that the

Motion by Councilman Petersen second by Councilman Gallo and carried
that this meeting be adjourn to Monday, May 19, 1958, at 8 o'clock p.m.,
Council Chambers, City Hall, Gilroy, California.
