Present: Councilmen Carl W. Pate, Courtland M. Rush, Kenneth L. Petersen, Everett C. Wentworth, Charles Gallo, and Wilford E. Jordan. The I0ayor now asks if all Councilmen have received copies of the minutes of the regular monthly meeting of August 4th and the regular adjourned meeting of August 18th. The Councilmen answer in the affirmative. The Mayor now asks if there are any errors or omissions in the minutes as presented. No errors or omissions are noted. The Mayor now declares the minutes of the regular monthly meeting of August 4th and the regular adjourned meeting of August lR, 1958 approved. A letter from the Central Labor Council of Santa Clara County is read requesting that the Mayor proclaim September 1st through ' September 7th as "Union Label Week". Motion by Councilman Rush second by Councilman Wentworth and carried that this matter be tabled. Letters from Mr. ~ Mrs. P. N. Alexander and Mrs. Irene Rennoe are read commending the Rascal's Car Club. The Clerk is directed to send photostatic copies of these letters to the Rascal's Car Club. A letter from the Regional Water Pollution Control Board is read stating results of samples taken during June 1958 at the sewage plant. Max Kludt explains that the Regional Water Pollution Con- trol Board is quite pleased with our sewage plant operation. A letter from Logan and Frazer is read offering to audit the City's books for the fiscal year 1958-1959 for $400.00. Motion by Councilman Pate second by Councilman Petersen and carried that the offer of Logan and Frazer to audit the City's books for the 1958- 1959 fiscal year for the sum of $400.00 be accepted. A letter from the City Marshal is read recommending hiring of Eugene C. Jewell as patrolman. Motion by Councilman Pate second by Councilman Wentworth and carried that Eugene C. Jewell be hired as patrolman for the six months probation period subject to a physical examination. The Marshal and City Administrator are dir- ected to contact a doctor who will give the examinations and also obtain physical examination forms. The Mayor now asks that the bids for the reroofing of Woeeler Auditorium be opened. The bids are now opened and read-as follows: Burton and Cluff for Proposal #2 calling for a fiber glass roof- ~3425.00; California Roofing Company for Proposal #1 which calls for an as~estos built up roof, $6393.00: and Keith Roofing Company Proposal)!l -$3711.00 and Proposal~2 - ~2906.00. The bids are referred to the Buildings and Grounds Committee for study and 19 6) () ,) .:..J recommendation to the Council on September 15th. At this time there is a public hearing on an application for a Use Permit to construct the Bethany Temple, Pentecostal Church of God on the northwest corner of Dowdy and Eighth Streets. The Mayor asks if there are any protests. There are none. Mr. E. L. Moon re- ports that everyone present is in favor of the application for the Use Permit. Resolution No. 476A is presented by the City Attorney. Motion by Councilman Rush second by Councilman Jordan that Resolu- tion No. 476A be adopted. Councilman Gallo reports that the request from the Rascal's Car Club to endorse their constitution was studied by the Ordinance Committee. The Ordinance Committee has decided that it is not regu- lar procedure for the Council to sign or endorse the constitution of a club over which it has no' control. The Clerk is directed to write a letter to the car club stating that the Council is in accord with the principles set forth in their constitution. Max Kludt presents requests from Win-Do Inc. to erect'a sign at the corner of Wayland Lane and First Streets and also at 781 N. Monterey Street on the side of a cafe. The Director of Public Works asks that the request be deferred because the plans submitted were not sufficient in detail. Resolution No. 477 is presented by Cecil A. Reinsch. Motion by Councilman Petersen second by Councilman Pate and carried that Resolution No. 477 be adopted. Councilman Petersen compliments Cecil Reinsch on his fine job in preparing the Civil Defense Plan. Resolution No. 47~ is presented by Cecil A. Reinsch. Motion by Councilman Pate second by Councilman Wentworth and carried that Resolution No. 478 be adopted. RESOLUTION NO. 478 (70 STAT.493), THE FEDERAL SURPLUS FEDERAL PROPERTY WHEREAS, BY PUBLIC LAW 655, 84TH CONGRESS GOVERr~1ENT HAS AUTHORIZED THE DONATION OF FOR CIVIL DEFENSE PURPOSES; AND PASSED AND ADOPTED THIS 2ND DAY OF SEPTEMBER 1958, by the Common Council of the City of Gilroy, State of California, by the following vote: AYE S : NOES: ABSENT: ~ Councilmen Pate, Rush,Petersen,Wentworth,Gallo, and Jordan Councilmen None Councilmen None 1.1I The City Attorney calls attention to errors in the proposed Rental Agreement with the County for the Judges Chambers. Toe City Attorney is directed to make the necessary corrections before sub- mitting it to the County. Resolution No. 479 accepting an easement from Harold C. Crow and Gwendolyn Crow is presented and read. Motion by Councilman Rush second by Councilman Petersen that Resolution No. 479 be adopted. 19BB RESOLUTION NO. 479 BE IT RESOLVED THAT THE CITY OF GILROY ACCEPT THAT CERTAIN DEED DATED MARCH 17, 1958, EXECUTED BY HAROLD C. CROW AND GVffiNDOLYN T. CROW, HIS WIFE, TO THE CITY OF GILROY BE ACCEPTED, AND THAT THE GRANTEE CONSENTS TO THE RECORDATION THEREOF. J Councilman Wentworth presents a letter from Mr. A. P. Vosti, Plant Mgr., from Gentry Division of Consolidated Foods requestin~ a meeting on the proposal of the City Engineer for diversion of industrial waste from the cannery and the Gentry Plant through storm sewers. The City Clerk is instructed to write a letter to Gentry stating that the Sewer Committee would like to meet with them at their convenience. The City Attorney presents and reads Ordinance No. 577. Motion by Councilman Pate second by Councilman Rush that Ordinance No. 577 be adopted. Councilman Pate states that temporary street barriers will be installed on September 12th on Forest Street for the con- venience of the High School until the street can be officially closed on September !5th. The City Attorney reports that the League of California Cities meeting with the Council will be as scheduled on September 4th at 8:00 P.M. unless an earlier dinner meeting with Mr. Kellar on that date can be arranged. Councilman Wentworth reports that there is an increase in the filter bed problem at the sewer farm, and that the correction of this problem will cost approximately ~750.00 for leveing, discing, and chiseling for new beds. This matter is referred to the Director of Public Works. The Council agrees that Mr. H. Allemand should be notified of the action taken. Councilman Wentowrth reports that the Police Commission rec- ommends that the parking north of town by Be Ge and Chris's Fine Foods should be limited to two hour parking. The City Attorney is irntructed to draft an amendment to the Traffic Ordinance for presentation at the next meeting. Councilman Wentworth reports that the City should be doing something about a proposed retirement plan. Cecil Reinsch reports that he is contacting several insurance companies on the matter. Councilman Petersen reports that the matter of hirin~ a full time maintenance man at the City yard should be investigated. The Clerk is instructed to obtain approximate figures of the cost of labor and maintenance on the City's equipment for the 1957-58 fis- cal year. Councilman Pate reports that the City Engineer does not have any further information on the North Monterey Street Right of Way at the present time. Councilman Pate announces that a stop sign has been installed on the corner of Murray and I. O. O. F. Avenues. The City Attorney is instructed to provide for this sign in the traffic ordinance. Councilman Pate also requests that the stop sign at the cor- ner of Tenth and Eigleberry Streets be removed. The City Attorney is directed to make provision for this in the traffic ordinance. Councilman Petersen reque3ts that stop signs be installed on Alexander Street at the intersection with 9th Street. The City Attorney is instructed to prepare an ordinance for the installa- tion of these stop signs. The City Clerk is instructeQ td find out if we are ever going to have the traffic survey by the California Automobile Association. Councilman Gallo requests that the electroliers be painted silver. Cecil Reinsch is instructed to find out from the State if they will allow the City no paint the electroliers silver. Councilman .Jordan asks if there has been any progress on the , sewer line right of way in the 4th Western Addition. The City Attorney reports that he is waiting for a meeting with the Bank of America who is handling the Devine Estate. Councilman Rush asks Max Kludt about the further spraying of the elm trees. Max Kludt reports that the Sunland Industries have stated that any further spraying this year will be useless. l19~i 4 I Mayor Sanchez reports that in the future all card room and bil- liard licenses must have approval of the City Council and the Mayor, and the Marshal must make a written recommendation to the Council before any license of this type can be issued. The City Attorney is requested to prepare an amendment to the License Ordinance pro- viding for this change. Councilman Wentworth reports that the Army-Engineer plan for using the sewer farm bridge for transportation of borrow material for the repair of levees on Llagas Creek was denied because the capacity of the bridge will not warrant the transportation of heavy loads. Motion by Councilman Pate second by Councilman Rush and carried that bills as presented be allowed and warrants drawn on the Treasurer. The Mayor announces a Legislative Committee Meeting on free- way problems on September 3rd in Sacramento, and also on September 4th a Santa Clara County Inter-City Council meeting in 6upertino. Reports of the Police Department, Poundmaster, Building Ins- pector and City Officers are presented and read. Motion by Council- man Wentworth second by Councilman ,Jordan and carried that these reports be accepted as read.
