This regular adjourned meeting of the Common Council is called
to order by His Honor Sig Sanchez.
Present: Councilmen Carl W. Pate, Kenneth L. Petersen, Court-
land M. Rush, Everett C. Wentworth, Charles Gallo, and Bill Jordan.
A letter from R. J. Evans, Chief Architect of the University
of California, is read acknowledging receipt of a letter from Mayor
Sanchez concerning the advantages of locating a branch of the Uni-
versity of California in the Gilroy area. The letter is ordered
filed.
A letter from John S. Harnett, Colonel of the U. S. Army Eng-
ineer District, is read reporting that Granite Construction Com-
pany has been awarded the contract to perform restoration work on
the levee along Llagas Creek.
The Mayor nqw asks that the bids for lawn and plumbing work at
Miller Park be opened. The bids are opened and read as follows:
Frank Vigna Plumbing Company - ~7918.00 and Treichel Hardware and
Plumbing Company 310250.00. The bids are turned over to the Citv
Attorney for inspection.
At this time there is a public hearing on the closing of For-
est Street through the high school property. The Mayor asks if
there are any protests. There are none. The City Attorney pre-
sents and reads Ordinance No. 578. Motion by Councilman Pate second
by Councilman Petersen that Ordinance No. 578 be adopted.

AN ORDINANCE OF THE CITY OF GILROY VACATING AND ABANDONING THAT
PART OF FOREST STREET BETNEEN I.O.O.F. AVENUE AND SWANSTON LANE,
IN THE CITY OF GILROY.
. ADOPTED AND PASSED this 15th day of September, 1958, by the fol-
lowing votes:

Purchasing Agent Reinsch after thorough investigation recom-
mends that the reroofing of Wheeler Auditorium be awarded to Keith
Roofing Company for $2966.00 on proposal /12 which is a fiber r:lass
roof. Motion by Councilman Petersen second by Councilman Wentworth
and carried that the Keith Roofing Company be awarded the contract
for the reroofing of Wheeler Auditorium for the sum of ~2906.00

for a fiber glass roof.
The agreements with the County for communication services and
telephone answering services are tabled until the lease for the
Judge's chambers has been corrected, signed, and returned to the
City of Gilroy for approval.
City Administrator Carr presents the total expenditures for
maintenance of city equipment for the 1957-58 fiscal year. Council-
man Pate suggests that the possibility of hiring a full-time main-
tenance man be delayed u~til the 1959-60 budget is prepared. No
further action is taken.
Councilman Jordan, Chairman of the Water Committee,reports
that the City Attorney has stated that the City has the right to
overflow the water from the City Reservoir into the existing over-
flow ditch. ~~ayor Sanchez explains the situation and instructs
the City Attorney to write a letter notifying the property owner
involved, ~iving two days notice to prepare a ditch through his
property to the creek to take care of the overflow. Director of
Public Works Kludt is instructed to deliver the letter to the
property owner.
The City Attorney reports that the bid of Treichel Hardware
and Plumbing Company is not in order because it is not accompanied
by the proper documents. The City Attorney also reports that the
Frank Vigna Plumbing Company bid is in order. Motion by Council-
man Petersen second by Councilman Rush and carried that the con-
tract for the work at Miller Park be awarded to Frank Vigna Plumb-
ing Company for their bid of $7918.00.
City Administrator Carr presents the annual library report
submitted by the Librarian, Marjorie Grodhaus. Motion by Council-
man Rush second by Councilman Pate and carried that the annual
report of the Gilroy Library be accepted as read.
Personnel Director Reinsch suggests that a Council Committee
be appointed to help prepare specifications for a retirement plan.
Personnel Director Reinsch and City Administrator Carr are in-
structed to submit a plan for approval before submitting it to
the various insurance companies for bids.
Mayor Sanchez submits the names of Mark Kennedy, Dr. Elmer
Chesbro and Roy Mead for reappointment to the Planning Commission
also Ise Og~wa and Francis Howson for reappointment to the Recrea-
tion Commission, their terms having expired. After a discussion
on the reappointment of Dr. Chesbro a motion is made by Council-
man Pate second by Councilman Rush and carried that Mark Kennedy,
Dr. Elmer Chesbro, and Roy Mead be reappointed to the Planning
Commission and Ise Ogawa and Francis Howson be reappointed to the
Recreation Commission.
The City Attorney presents and reads Ordinance No. 579.
Motion by Councilman Pate second by Councilman Rush that Ordinance
No. 579 be adopted.

INANCE NO. 480 OF SAID CITY, KNOWN AS THE TRAFFIC ORDINANCE, AS
AMENDED, BY ADDING SUBDIVISIONS 26, 27, AND 28, PROVIDING FOR
, PLACING OF ADDITIONAL STOP SIGNS.

A report on water samples taken by the Santa Clara County Health
Department on September 3rd are read. The reports are satisfactory
and are ordered filed.
Mayor Sanchez announces a League of California Cities dinner
meeting on September 3rd in Palo Alto to review emerging City prob-
lems and the 1958 League Conference. Mayor Sanchez also announdes
the Leag;ue Conference in Los Angeles on October 26th to 29th stating
that he is planning to attend and asks those Councilmer who wish to
attend to send in their reservations as soon as Dossible.
Councilman Wentworth asks Purchasing Ao:ent Reinsch for his re-
port on the Golf Course pipe line bids. Purchasing AO'ent Reinsch
reports that Chappell Pump Company and Brahamn Pipe Company have ..
submitted bids for the pipe line and recommends that the bid be re-
ferred to the Buildings and Grounds Committee for study. ..
Councilman Petersen reports that he would like City Administra-
tor Carr and the City Attorney to arrange for a date to hold an elec-
tion for a proposed freeholders charter. Councilman Pate suggests
that a committee of the entire Council be held on Sentember 22nd to
further discuss the charter matter. All Councilmen agree on a meet-
ing at 8:00 P.M. on September 22nd with the City Attorney to be
present.
The City Attorney presents and reads his report clarifying
statements made at a previous charter meeting by rf,r. Kellar of the
League of California Cities.
- Councilman Rush instructs Director of Public Works Kludt to
further investigate the problem of the beetles on Fifth Street that
are injuring the elm trees. Mr. Joe Silano now appears before the
Council expressing his opinion on the Holland Beetle now infesting
the Elm Trees.
Councilman Pate recommends that Director of Public Works Kludt
and City Administrator Carr be delegated to select appraisers for
the Welburn Avenue right of way. Motion by Councilman Pate secorld
by Councilman Rush and carried that Max Kludt be delegated as the
Right~of-Way Agent for the City of Gilroy.
Mayor Sanchez asks the City Attorney to give a report on the
George THhi te accessory building. Mr. Johnson states that he 'hopes
to have the complaint ready for copy at the end of the week. ..
Councilman Jordan asks if there has been any progress on the
sewer line right' of way in the 4th '!vestern Addition. The City 11II
Attorney states that it is progressing and he will prepare a peti-
tion for annexation of the five acres of the Clark proDerty as un-
inhabited territory. He also states that all legal matters should
be completed within six weeks.
Mayor Sanchez as a matter of record reviews the City policy
regarding Council Committees stating that the Committee Chairmans
can instruct the City Administrator Carr to proceed with emergency
and routine matters and all budget itsms already approved by the
Council and that all other items other than emergency and routine
matters not set forth in the budget must be brought before the
Council for approval.

Director of Public Works Kludt requests that stOD signs be re-
moved on I.O.O.F. Avenue at Forest Street and on Swanston Lane
at Forest Street and on Forest Street at Swanston Lane. Tnis
matter is referred to the Ordinance Committee.
Director of Public Works Kludt requests that "Not a Thru Street"
signs be installed on Swanston Lane at Leavesley Rd. and on Forest
Street at Leavesley Road. The City Attorney reports that this
is a matter of warning and no ordinance is necessary. This matter
is referred to the Street Committee.
Personnel Director Reinsch reports that he has the physical
examination forms for future full-time employees and recommends
that they be handled through the City Clerk's Office.
Motion by Councilman Pate second by Councilman Rush and
carried that this Council meeting be adjounred.
