Prese'nt: Councilmen Kenneth L. Petersen, Courtland M. Rush, Everett C. Wentworth, Charles Gallo and Wilford E. Jordan. Absent: Councilman Carl W. Pate. The ~myor announces that this is the time for the public hearing on the abandonment of the right-of-way in Sherwood Park. The Mayor asks if there are any protests. There are none. The City Attorney presents and reads Ordinance No. 5S4. Motion by Councilman Rush second by Councilman Wentworth that Ordinance No. 5S4 be adopted. Councilman Pate arrives and takes his seat at the Council table during the reading of Ordinance No. 5S4. 1941 ORDINANCE NO. 584 AN ORDINANCE OF THE CITY OF GILROY VACATING AND ABANDONING A TEN FOOT ALLEY OR RIGHT OF WAY, THE CENTER LINE OF WHICH IS THE LINE DIVIDING LOTS 61 AND 62 OF SHERWOOD PARK UNIT NUMBER ONE. ADOPTED AND PASSED this 20th day of October, 1958, by the follow- ing votes. AYES: Councilmen: Pate,Rush,Gallo,Wentworth,Petersen,Jordan NOES: Councilmen: None ABSENT: Councilmen: None The Mayor reports that a Camp Fire Girls group and their leaders, Mrs. William Steinburg and Mrs. Everett Wentworth, are in the audience. One of the Camp Fire Girls thanks the Council for inviting them to be present at the Council meeting. Director of Public Works Kludt, states that he has a re- quest for a variance from regulations as set forth in the Zon- ing Ordinance for construction of a garage at Third and Church Streets. He requests that this matter be referred to the Plan- ning Commission for their recommendation. The request is ordered referred to the Commission. An application for an on-sale beer and wine license for Bernade L. Soza is read. All Councilmen have no objections to this application. Director of Public Works Kludt reports that an ordinance for controlling parking of trailers is prepared. Chief Adminis- trator Officer Carr presents and reads Ordinance No. 585. NOES: Councilmen: None ABSENT:Councilmen: None _,,J I I..J Director of Public Works Kludt requests that a reconsi- deration be made for removing the stop sign on Forest Street at I.O.O.F. Avenue and for the placing of stop signs on I.O.O.F. Avenue at Forest Street. Discussion is had on the matter. All Councilmen are in agreement with installing stop signs east and west on I. O. O. F. Avenue and preparing an amendment to the traffic ordinance for their installation. It is agreed that the TtoP sign not be removed on ForeBt Street at I.O.O.F. Avenue. he City Attorney is instructed to prepare an 'Ordinance for the installation of these stop signs. Chief Administrative Officer Carr presents and reads the following names as appointees of the Council for the Charter Ad- visory Committee: Vernon Gwinn, Francis Basch, Fred Lovingier, Norman Goodrich, Marion Link, I. F. Aldridge, Andrew Battagin, Dr. James D. Neilson, Henry Del Biaggo, Art Bannister, Elmer Steinmitz,. Donald Strahl, Eugene Ward, Francis CraWford, and 1942 Bruce Jacobs. Chief Administrative Officer Carr is instructed to call the citizen's committee informing them of a meeting on Octo- ber 23rd at 7:30 P.M. with the Councilmen. Chief Administrative Officer Carr requests the adoption of a resolution to discontinue the General "Bit and Auditorium f\fuint- enance Funds. Resolution No. 4g2 is presented and read by the City Attorney. Motion by Councilman Wentworth second by Council- man Petersen that Resolution No. 482 be adopted. PASSED AND ADOPTED this 20th day of October, 1958, by the follow- ing vote: AYES: Councilmen: Pate,Wentworth,Gallo,Rush,Petersen,Jordan NOES: Councilmen: None ABSENT: Councilmen: None , Chief Administrative Officer Carr requests for a transfer of $135,000.00 from the Water fund to the Water Line Replacement Fund. Motion by Councilman Pate second by Councilman Rush and carried that $135,000.00 from the Water Fund be transfered, as recommended by the Chief Administrative Officer, to the Water Line Replacement Fund. Chief Administrative Officer Carr reports on a hearing before the Water Pollution Board on October 10th regarding a change in handling of effluent from Gentry Company. He r~ports that the Water Pollution Board makes the following recommenda- tions: that the City proceed as quickly as possible with an out- fall line, that the Gentry Company provide very fine screening of the effluent at their plant, that the waste be kept out of Llagas Creek, that if necessary the effluent be treated for odor, and that the proper mosquito control be exercised. At this time their is some discussion on the matter. Councilman 'Iventworth re- po~ts that this will not be at City expense. Chief Administrative Officer Carr requests for an appoint- ment of two city officials as official representatives to the Inter-City Council. The Mayor appoints Councilmen Wentworth and Petersen as official representatives to the Inter-City Council. Councilman Rush reports that the Fire Committee recommends that Fireman Engineer, R. L. Schneider, be dismissed. Motion by Councilman Pate second by Councilman Wentworth and carried that R. L. Schneider be dismissed and that Chief Administrative Officer Carr notify Mr. Schneider that he has the right to appear before the Council for a hearing. Councilman Rush, Chairman of the Fire Committee, recommends that Vernon M. Naughton be hired as Fireman-Engineer subject to his physical examination. Motion by Councilman Wentworth second by Councilman Petersen and carried that Vernon M. Naughton be hired as Fireman-Engineer subject to a physical examination. Councilman Pate reports that a stranger in town has com- plimented three officials in the Clerk's Office for their cour- teous manner in assisting him. Councilman Gallo reports that the Ordinance Committee had a meeting concerning a proposed subdivision ordinance and at the present time it has been placed in the hands of the City Engineer and Attorney. Councilman Gallo also reports that the Ordinance Committee is working on the proposed garden refuse ordinance. ... .. ~ .J 194B Director of Public Works Kludt reports that the Sewer Committee has had a meeting and has decided to install the sewer line for. the Fourth Western Addition along Miller Avenue. Councilman Gallo asks the Councilman when they want the electroliers painted. There is some discussion on the matter. It is agreed to have them painted as soon as it can be conven- iently scheduled. Reports of water samples taken by the Santa Clara County Health Department on September 30th are read. The reports are satisfactory and are ordered filed. Director of Public Works Klu6t reports that the work at Miller Park has been progressing satisfactorily. City Engineer Hanna Jr. reports that any person who wishes to make an amendment to an Ordinance for their own benefit should be charged a deposit fee to cover the advertisement charges. The City Engineer also reports that the contractors who are planning to bid on the Welburn Avenue Bridge would prefer making their bids in the spring. Councilman Rush instructs Chief Administrative Officer Carr to contact the Police Commission every third Monday for a Police meeting at 7:00 P.M. Motion by Councilman Pate second by Councilman Wentworth and carried that Mayor Sanchez, Councilman Petersen, and Chief Administrative Officer Carr be appointed as representatives of the City to attend the League of California Cities convention in Los Angelew on October 26th through October 29th.
