FOR ON -CALL CONSTRCUTION MANAGEMENT DATED AUGUST 22, 2013 This Amendment shall become effective when it has been signed by the City Administrator, Project Manager, and Consultant. All copies forwarded to Consultant for signature shall be returned to the City of Gilroy properly filled out. Upon acceptance by the City, the Consultant's copy will be returned to him as his authority t_ proceed with the work. This Amendment extends the term of the Agreement for Services between the City of Gilroy and Nova Partners Inc., dated August 6, 2012 to May 1, 2014. All requirements of the original Agreement Documents shall apply to the above work except as specifically modified by this Amendment. The contract time shall not extend unless expressly provided for in this Amendment. The scope of work authorized includes Construction Management and Design services to support the Engineering Division for additional work required for the Design and Construction of a future Paseo located at 7453 Monterey Street. Consultant acknowledges that the construction of the Paseo is currently not funded at this time. This amendment covers the additional Management and Design services as outlined in the attached Nova Partners proposal dated 8/22/13. Costs for services are estimated at $122,0255. As you may recall, the initial phase of this project was the recent demolition of the 7453 Monterey Road commercial building along with the reinforcement to the two (2) adjacent properties as a result of this demolition. Remediation to the existing grounds are necessary to make use of the property. This remediation or capital improvements project will include a pedestrian walkway (i.e. paseo) between Monterey street and an existing rear parking lot off of Gourmet Alley. The design will be based on concepts provided by Aitken & Associates and approved by City of Gilroy council at a future date tentatively scheduled in the October 2013 time frame. Nova Partners will provide oversight of design and construction activities, generation of drawings for permit submission, and an allowance for testing and inspections to insure the project is completed by April 2014 or as approved by Council. Below, please find Nova Partners cost request for additional Design, Engineering, Special Testing, and Construction Management services for the above reference project as specifically outlined on the next page. Design Management and Over sight August 2013 - December 2013 - We have allotted approximately 10 hours a week to cover the Design Management services that are currently scheduled to occur during the periods from August 2013 through December 2013. This is an estimate of time required to ensure we stay current with the needs of the City. We will only bill for work performed on this phase of the project and will not exceed this value without prior authorization by the City. II. Construction Management January 2014 - March 2014 - We have allotted approximately 20 hours a week to provide Construction Management oversight services during the duration of this phase of the project. We feel this is a conservative amount of time to oversee this project that is not completely defined at this time. This is an estimate of time required to ensure we stay current with the needs of the City. We will only bill for work performed on this phase of the project and will not exceed this value without prior authorization by the City. Therefore, Nova Partners requests an increase to our current On -Call Agreement in the Not to Exceed amount of $122,055 as indicated above.
