RE: Joint Exercise of Powers Agreement for the HOME Investment Partnership Program for
the term of October 1, 2014 to September 31, 2017.
Dear Ms. Cremer,
Enclosed is a copy of the fully executed HOME Cooperation Agreement approved by the County of
Santa Clara Board of Supervisors on June 24, 2014 for the HOME Investment Partnership Program.
The Supervisors adopted a resolution authorizing the Board President to execute a HOME Consortium
Agreement with the cities of Cupertino, Gilroy and Palo Alto for Federal Fiscal Years 2014 through
2017 with an option to automatic renew the JPA.
A copy of the fully executed Agreement and resolution from each jurisdiction are enclosed for
review and approval by the U.S. Department of Housing and Urban Development. A copy of the
County of Santa Clara General Counsel's legal opinion regarding the formation of the Consortium is
also enclosed.

I, the undersigned, hereby certify that the terms and provisions of the HOME Consortium
Agreement are fully authorized under the Joint Exercise of Powers Act (CA Govt. Code section
6500 et seq.) The HOME Consortium Agreement has been approved by the City Councils of
Cupertino, Palo Alto, and Gilroy, and the County of Santa Clara Board of Supervisors. Therefore
under California Government Code Section 6502, the Agreement provides full legal authority for
the consortium to undertake housing assistance activities for the HOME Program and for the
County of Santa Clara to undertake or assist in undertaking essential community development and
housing assistance activities financed . through the United States Housing and Urban
Development's HOME Investment Partnerships Program.

RE: County of Santa Clara HOME Consortium Certification
Dear Ms. Garcia
This letter is in response to your request for State Certification of the County of Santa Clara
HOME Consortium. We understand that participating members of the County of Santa Clara
HOME Consortium will include the Santa Clara County Urban County and the cities of
Cupertino, Gilroy, Milpitas, and Palo Alto.
Based upon information provided regarding your objectives for the use of HOME funds, I am
pleased to provide State certification of the County of Santa Clara HOME Consortium. Our
review is undertaken pursuant to Section 216(2) of the Cranston - Gonzalez National Affordable
Housing Act as amended, (42 U.S.C. 12701, et. seq.) (Act), which authorizes geographically
contiguous local governments to form a consortium to administer HOME Program funds.
Procedures for designating the consortium and its renewal are further detailed in HUD
Directives. The Act requires written certification by the State that the Consortium will direct its
activities to the alleviation of housing problems within the State.
HUD has directed the State to continue to monitor the performance of all cities and counties,
(State Recipients), which have received HOME funds from the State, even if they are now
members of a consortium or urban county. This includes monitoring of Program Income and
long -term rental property issues. Each of these State Recipients must continue to file quarterly
reports until all Project Completion Reports have been filed. Further, they must continue to file
Annual Reports, monitoring reports and any other necessary reports as long as the State
Recipient retains Program Income.
Final determination of membership from HUD is needed to confirm the member cities of your
consortium. Please forward an executed copy of the agreement between HUD and the County
of Santa Clara HOME Consortium to our office. The agreement also serves as a guide in
determining eligibility of cities and counties for the State HOME Program. Provided that the
agreement confirms the membership of the consortium as stated above, pursuant to State
HOME Regulation 8204, these areas will not be eligible to receive State HOME Program funds
from federal allocations for the period covering your HUD Consortium approval. Note: pursuant
to CPD Notice 13 -002, participants in the CDBG Urban County are also considered part of the
HOME Consortium since Santa Clara County is a member of the HOME Consortium. Hence,
these cities are also ineligible for State HOME funds.
We wish you continued success in achieving your affordable housing objectives through the
HOME Consortium. If we can be of assistance to Consortium members in any way, please

jurisdiction's fully executed JPA and associated documents have been forwarded to the U. S.
Department of Housing and Urban Development for final review and approval.
