FIRST AMENDMENT TO HEWELL ANNEXATION AND PREZONE INITIAL STUDY WHEREAS, the City of Gilroy, a municipal corporation ( "City "), and EMC Planning Group, Inc. entered into that certain agreement entitled "Hewell Annexation and Prezone Initial Study," effective on October 22, 2013, hereinafter referred to as "Original Agreement "; and WHEREAS, City and EMC Planning Group, Inc. have determined it is in their mutual interest to amend certain terms of the Original Agreement. NOW, THEREFORE, FOR VALUABLE CONSIDERATION, THE PARTIES AGREE AS FOLLOWS: 1. Exhibit B, "Scope of Services," of the Original Agreement shall be amended to include the attached "Hewell Annexation and Prezone Initial Study Contract Amendment #1" scope of work. 2. Exhibit C, "Payment Schedule," of the Original Agreement shall be amended to increase the total contract amount to $66,716.00. 3. This Amendment shall be effective on October 30, 2014. 4. Except as expressly modified herein, all of the provisions of the Original Agreement shall remain in full force and effect. In the case of any inconsistencies between the Original Agreement and this Amendment, the terms of this Amendment shall control. 5. This Amendment may be executed in counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument. The site is within the Gilroy 2002 1 2020 General Plan (City of Gilroy 2002) (hereinafter "general plan ") 20 -year planning boundary and outside of the Urban Service Area (USA) boundary. The USA boundary borders the project site to the east. The project site and the surrounding parcels are designated as Neighborhood District in city's general plan. The proposed project is USA amendment, pre -zone of the site as Neighborhood District (ND), and detachment from the South Santa Clara County Fire Protection District. No development is proposed at this time; however a conceptual development plan was submitted for purposes of showing how the property could be developed, consistent with the city general plan land use designation of Neighborhood District. The proposed project would consist of 48 residential units ranging from 1,049 square feet to 6;395 square feet as shown on the conceptual development plan. Roadway improvements would include completing the extension. of Vickery Avenue west to Kern Avenue, extending Kern Avenue north along the western property boundary, and extending Cohansey Avenue from the project site's eastern edge, west to Kern Avenue. In addition to the USA amendment, future development of the site will require city approval of a specific plan, a tentative map, and architectural site review. 1.2 History In August 2013, the city issued a Request for Proposal (RFP) for an environmental review for the Hewell annexation and prezoning. EMC Planning Group began work on an initial study for the project in December 2013. To date the draft is approximately 90 percent complete pending city review of the draft transportation impact analysis (Hexagon) and submission of the applicant's preliminary geotechnical and /or soils reports. The city discovered that LAFCO has no records indicating that the Hewell property is within the City of Gilroy's USA. Therefore, the applicant will need to file a USA amendment application. The city has asked EMC Planning Group to revise their scope of work to address the USA request. EMC PLANNING GROUP INC. 1 HEWELL URBAN SERVICE AREA AMENDMENT CEQA AND LAFCO DOCUMENTATION 2.0 SCOPE OF WORK 2.1 Approach The current draft initial study evaluating the Hewell annexation and prezone will be revised to also evaluate the USA amendment request. It is assumed that the analysis done thus far is adequate for evaluation of the USA for most environmental issue areas. However, the following initial study sections will require more substantial revision: Project Description The project description will be updated based upon the need for a USA amendment. Land Use and Planning Applicable City of Gilroy General Plan policies and LAFCO USA amendment and annexation policies will be thoroughly evaluated for consistency. A detailed Consistency Analysis will be prepared and will be summarized in this section of the initial study. The current CEQA evaluation will be revised as necessary based upon. the current project description and the conclusions of the Consistency Analysis. The complete Consistency Analysis will be included as an appendix to the initial study. Public Services and Utilities (Plan for Providing Urban Services) This section will be updated based upon the existing project description and Plan for Providing Urban Services ( "plan") (refer to the LAFCO documentation scope of work presented later in this proposal). The plan will be included as an appendix and summarized in this section of the initial study. The plan addresses fire protection, police protection, schools, parks, water, wastewater, and storm drainage. 2.2 Deliverables EMC Planning Group will prepare documentation in compliance with CEQA consistent with our original scope of work and our October 2013 Hewell Annexation and Pre- zoning Initial Study Agreement for Services. EMC PLANNING GROUP INC. 2 HEWELL URBAN SERVICE AREA AMENDMENT CEQA AND LAFCO DOCUMENTATION 3.0 LAFCO DocuMENTATION SCOPE OF WORK The Santa Clara County Local Agency Formation Commission (LAFCO) requires a variety of studies /documentation to be submitted with the USA application. These studies include a plan for providing urban services, a fiscal impact analysis, mapping, and a vacant land inventory. The scope of work for each of the items is described below. 3.1 Plan for Providing Services A plan for providing services is a requirement of LAFCO approval of the USA amendment request. The contents of the plan for providing services are identified on LAFCO's website in a document dated April 2003. A plan for providing services will be prepared, using the same format as the plan for providing services for the Wren USA amendment. The following tasks will be completed: Task I Water Supply The proposed project is not large enough to require a water supply assessment. EMC Planning Group will consult with City staff, water district staff, and the applicant's engineer to determine existing and future water infrastructure needs. Task 2 Sewer Service Consult with the following documents, agencies, and individuals to determine the project's expected wastewater generation, the capacity of the wastewater treatment plant to handle the additional flows, any improvements that would be required, existing sewer infrastructure, and new infrastructure needs: City of Gilroy Sewer System Master Plan (2004), City of Gilroy Engineering Division, South County Regional Wastewater Authority, and the applicant's engineer. Task 3 Storm Drainage Consult with the following documents, agencies, and individuals to determine' the project's expected storm water runoff, the capacity of the city's existing system to handle the additional runoff, any improvements that would be required, existing storm drainage infrastructure, and new infrastructure needs: City of Gilroy Storm Drainage System Master Plan (2004), the City of Gilroy Engineering Division, and the applicant's engineer. EMC PLANNING GROUP INC. 3 HEWELL URBAN SERVICE AREA AMENDMENT CEQA AND LAFCO DOCUMENTATION Task 4 Police Protection Service Consult with the City of Gilroy Police Department regarding the capacity of the department to serve the proposed project. Task 5 Fire Protection Service Consult with the City of Gilroy Fire Department regarding the capacity of the department to serve the proposed project. EMC Planning Group will also consult with the City of Gilroy Fire Services Master Plan (2004). Task 6 Prepare Draft Plan for Services Prepare a draft plan for services and provide two (2) copies for review and comment by city staff. Task 7 Prepare Final Plan for Services Prepare the final plan for services and provide thirty-five (35) hard copies and one (1) CD. 3.2 Fiscal Impact Analysis Applied Development Economics (ADE) will prepare a fiscal impact analysis prepared for the USA amendment applications. The scope of work for the fiscal impact analysis is included as Attachment A. 3.3 Mapping EMC Planning Group will prepare mapping sufficient for LAFCO's needs, in consultation with city staff. 3.4 Residential Vacant Land Inventory EMC Planning Group will update the vacant land inventory, as part of this USA application. The update will involve the following subtasks (as necessary): • Revise Section 1.0 - Background discussion; • Update discussion and tables for Residential Development Ordinance (RDO) Allocations Summary; • Update Section 2.0 - Vacant Land Supply and Table; EMC PLANNING GROUP INC_ 4 HEWELL URBAN SERVICE AREA AMENDMENT CEQA AND LAFCO DOCUMENTATION • Update figures; and • Update Section 3.0 - Growth Projections. EMC Planning Group will prepare a draft and final report, including tables that summarize quantitative data and maps, discuss the methods used in the inventory, and report findings of the study. EMC Planning Group will provide one (1) electronic PDF and one (1) electronic Word version of the draft to staff for review and comment. Based on staff comments on the draft report, a final report will be prepared for use in the LAFCO application. EMC Planning Group will provide thirty -five (35) printed copies and one (1) CD of the final report to the city. 4.0 NOT -TO- EXCEED BUDGET AND PRELIMINARY SCHEDULE A not -to- exceed budget is presented on the following page. A project schedule will be prepared upon notice to proceed. The revenue impact to the County of changing the property tax jurisdiction from the County to the City. 2. The direct and indirect service cost impacts to the county of the proposed development on the site. Direct impact are imposed by residential developments that add population which must be provided with certain County services such as criminal justice and health care despite being located in the City of Gilroy. Indirect impacts are generated by non - residential development that may induce population growth with similar impacts. 3. The ability of the City to sustain the fiscal impact of the development on its own services and public facilities. 4. Preparation of a public services plan for the project. Task 1: Update Fiscal Models Based on the concerns outlined above, the study is required to address fiscal impacts both to the County and to the City. ADE has developed fiscal models for both jurisdictions for prior projects and we would update the models with current budget information for this project. ADE will work with EMC Planning Group to identify the population impacts of the proposed project in order to calculate the public service demands and fiscal impacts on both the City and the County. ADE will estimate the revenue potential of the project based on an analysis of likely development values and household incomes. Task 2: Draft Report Using the fiscal impact model for Gilroy and the County, ADE will prepare a report outlining the projected fiscal impact on both jurisdictions both at full buildout and at specific future points in time as appropriate. ADE will prepare a brief analysis of the likely market absorption of the development and will indicate the phasing of costs and revenues in the fiscal analysis. The report will present a public cash flow analysis for the market absorption period for the project. The report will include recommendations for mitigating any fiscal impacts identified in the analysis. Task 3: Final Report Based on comments received from City staff, ADE will revise the draft report as needed and provide a final public draft of the report.
