1940 AMERICAN LAFRANCE FIRE TRUCK AGREEMENT
This loan agreement is executed by and between the City
of Gilroy, the Gilroy Historical Society, a Califronia non-
profit corporation ( "Society ") and Michael Bonfante, DBA
Tree Haven, (Tree Haven), Hecker Pass Highway, Gilroy,
California.
Whereas the City of Gilroy owns a 1940 American LaFrance
Fire Truck which the Society desires to preserve for display
purposes, the parties agree as follows:
1. The Society is charged for an indefinite period with
responsibililty for the supervision of proper care and
housing of said Fire Truck.
2. Tree Haven shall pay for all labor, parts and equipment
required for restoration of said Fire Truck.
3. The said vehicle shall be on loan to Tree Haven for
display and maintenance at their property on Hecker Pass
Highway, Gilroy. Said vehicle shall not leave the premises
nor shall it be used for other than display.
4. Tree Haven shall insure both the City of Gilroy and the
Society, as named insured, for liability, for and all other
risks covered by standard extended coverage endorsement to
property and to protect all parties in regards to said Fire
Truck. Liability coverage shall not be less than one
million dollars (1.,000,000.00) per occurrence.
5. This agreement shall remain in effect until terminated
by mutual agreement o$r a thirty (30) day notice by any one
of the three (3) parties to the.ot -her two (2).
6. This agreement shall not be assigned or transferred by
any of the three (3) parties.
