City Council Meeting Minutes
January 4. 2016
(.OPENING
A. Call to Order
Mayor Pro Tempore Woodward called the meeting to order at 6:00 p.m.
The pledge of Allegiance was led by Mayor Pro Tempore Woodward.
Roll Call
Present: Council Member Terri Aulman; Council Member Dion Bracco; Council
Member Cat Tucker; Mayor Pro Tempore Peary Woodward
Absent/Excused: Council Member Peter Leroe- Munoz; Council Member Roland
Velasco
City Clerk Shawna Freels announced that the agenda had been posted on December
30, 2015 at 11:45 a.m.
B. Orders of the Day
There were no agenda changes.
C. Employee Introductions
Police Chief Turner introduced Office Assistant Tammy Puthoff and Officer Vanessa
Ruiz.
Council Member Roland Velasco joined the meeting at 06:02 p.m.
NEW BUSINESS
A. Appointment of a City Council Member to Fill the Vacant Seat of Mayor for the
Remainder of an Unexpired Tenn Ending November, 2016
The staff report was presented by City Clerk Freels.
There were no public comments.
Council Member Peter Leroe -Munoz joined the meeting at 06:05 p.m.
Motion on Item A
Motion: to Appoint a Perry Woodward to Serve as Mayor for the remainder of the
unexpired term ending November, 2016.
Moved by Council Member Dion Bracco, seconded by Council Member Cat
Tucker.
Vote: Motion carried 5 -1.

City Clerk Freels administered the oath of office to Mayor Woodward.
Mayor Woodward thanked the Council for the appointment sharing his thoughts on
serving as Mayor.
There was a discussion of selecting the Mayor Pro Tempore.

Susan Mister was called to speak stating that she didn't believe the Council should
consider the Mayor Pro Tempore appointment as the item was not on the agenda.
Bob Sigala was called to speak also stating that the Council should not consider the
Mayor Pro Tempore appointment as the item was not on the agenda.
Ron Kirkish was called to speak sharing his support of the appointment of Council
Member Leroe -Munoz as Mayor Pro Tempore.
Linda West was called to speak stating that she didn't see the opportunity for
community input or discussion about the appointment as it hadn't been agendized.
Walt Glines was called to speak explaining that he didn't think the Council should take
action without having the item on the agenda.
Public comment was then closed.

Vice Chair Hyde presented the report.
IV. REPORTS OF COUNCIL MEMBERS
Mayor Woodward reported that he had received an award for the city from the Silicon
Leadership group.
V. FUTURE COUNCIL INITIATED AGENDA ITEMS
Council Member Velasco asked for a brief overview of the recruitment process for
replacing Development Center Manager Butler.

Tentative Map TM 15 -01 , Creating 84 Single - Family Residential Lots, One

A. Authorization to Join the National Joint Powers Alliance and Award of a Bid
for the Miller Restroom Improvements Construction Project

Motion: to Adopt a Resolution 2016 -02 of the City Council of the City of Gilroy
Authorizing the City Administrator to Enter into an Agreement with the National
Joint Powers Alliance

VIII. PUBLIC HEARINGS
A. An Ordinance of the City Council of the City of Gilroy Amending the City Code
to Prohibit the Commercial Cultivation of Medical Marijuana Within the City
Limits (Z 15 -10)
The staff report was presented by Planning Manager Martin.
The public hearing was opened.
Ron Kirkish was called to speak asking if all members of a family could have 6 plants
growing at each household and then explained that the issue of underground pot shops
encouraged mass grows. He then suggested that the Council consider regulating the
number of plants per household.
Rebecca Armendariz was called to speak sharing her thoughts on the resources that
would be expended by the city in regulating marijuana, explaining that the resources
would be better used by focusing on meth labs, and other drugs.
Eric Howard was called to speak asking how the city law would be affected by the state
ballot measure.
The public hearing was then closed.

Second Motion on Item VIII.A.
Motion: to Introduce an Ordinance of the City Council of the City of Gilroy
Repealing Gilroy City Code Section 13.65 in Its Entirety; Amending Gilroy City
Code Section 30.2.20 to Add New Definitions Pertaining to the Prohibition of
Marijuana Cultivation, Processing, Delivery and Dispensary Uses; and Adding
New Sections to Article XLV of Chapter 30 Pertaining to the Prohibition of
Marijuana Cultivation, Processing, Delivery and Dispensary Uses in the City of
Gilroy with the additional language provided by the City Attorney regarding a
complete ban.

Leroe- Munoz.

X. INTRODUCTION OF NEW BUSINESS
A. Acceptance of the Proposed Gilroy 2040 General Plan Land Use Alternative
and Policy Text for the 2040 General Plan Environmental Impact Report
The staff report was presented by Senior Planner Ketchum.
Public comment was opened.
Susan Mister was called to speak sharing her thoughts on housing and the drain on
public services.
Ronald Gurries was called to speak sharing his thoughts on growth in the city and
suggested the Council table the discussion for a time to allow for more dialog.
Martha Schauss was called to speak stating that she believed the public was not being
heard as the community did not want growth to the north as planned in the general plan.
Bryan Riewerts was called to speak stating that the town had grown substantially since
he had moved to Gilroy in the 70's explaining that the roads in the city were in terrible
shape as the growth that had taken place had not taken into account the impacts on the
existing roads. He spoke on the need for apartments and the sky- rocketing prices of
single- family homes.
Cristi Curry was called to speak sharing her concerns with traffic in the city and smaller
street widths.
Connie Rogers was called to speak suggesting that language be inserted relating to
public safety response times and then spoke on the need for slower growth.
Carolyn Tognetti was called to speak stating that she believed the USA should have
been delayed until after the general plan land use recommendations had been
presented to the Council. She then spoke on the need to include fixed public safety

response times in the general plan as the public should establish the desired standards,
not the Council on an annual basis.
Bob Sigala was called to speak explaining that the city was not ready for the larger
developments as there was not enough water and the city had inadequate streets. He
then spoke on the city's delayed public safety response times and the need for
affordable housing, not single family homes.
Linda West was called to speak stating that the perception was that the Council was not
listening to the citizens as the GPAC had been compiled of members of the community.
Ron Kirkish was called to speak explaining that controlled growth helped stimulate the
local economy.
Adria Spano was called to speak stating that the community was asking the Council to
slow down on the growth, suggesting that a sustainable industrial park would be a
competitive advantage.
Kim Merrill was called to speak explaining that growth was inevitable, but business
needed to sustain the growth. He concluded by stating that Gilroy needed to focus on
bringing jobs to the community.
Mike Griffis was called to speak stating that the city did not need to grow so
dramatically.
Kimberly Merrill was called to speak stating that she saw Gilroy as a bedroom
community already, and the additional homes would just impact the commute more.
She spoke on the traffic on 10th street and downtown in comparison to downtown
Morgan Hill.
Eric Froelich was called to speak sharing his thoughts on slower growth.
Henry Coletto was called to speak explaining that numerous neighborhoods were
ignored and had no parks and poor roads.
Rebecca Armendariz was called to speak explaining that the east side of the city was
neglected and the planned growth to the north would only add more neglect of the east
side of the community.

Motion: to Adopt a Resolution 2016 -03 of the City Council of the City of Gilroy
Approving the Gilroy 2040 General Plan Preferred Land Use Alternative, as
Revised, and the General Plan Policy Text, as Revised, For Purposes of Defining
the "Project" to be Evaluated in the Draft Environmental Impact Report

use of the city seal.

XI. CITY ADMINISTRATOR'S REPORTS
City Administrator Tewes announced that with the pending rain during the week, sand

bags were available at the fire stations. He then explained that with the opening of the
Development Center Manager position, he would be re- organizing duties to accomplish
the work load as an interim measure of filling the position to meet the Council's
objectives.
He then spoke on the scheduling for the City Administrator applicant interviews.

There was no report.
