The California Conservation Corps (CCC) is a state entity that is self- insured for tort and
property liability and participates in a master agreement with other state and quasi -state
entities for vehicle and workers' compensation coverage. The CCC does not purchase
professional liability insurance nor does the CCC have the legal authority to name a
public or private entity as an "additional insured ". The CCC does not hold harmless,
defend or indemnify another public or private entity for claims in which the CCC is
determined to not be legally responsible.
As a state entity that is self - insured, any tort or property claims that involve the CCC or
its employees performing authorized duties are required to be filed in accordance with
the procedures set forth in the California Government Code Section 900 et seq.
Workers' compensation coverage and benefits are provided and administered by the
State Compensation Insurance Fund in accordance with the California Labor Code.
Motor vehicle claims are administered by the Department of General Services, Office of
Risk and Insurance Management.
Based on the above -noted indemnification limitations of the CCC, the CCC Sponsor
Agreement (CCC Form 96) includes the following "mutual" indemnification provision:
To the extent permitted by law including Article XVI, sections 1 and 6 of
the California Constitution, and the California Tort Claims Act, the CCC
agrees to hold harmless and indemnify the Sponsor against any liability,
damage, or loss legally determined to have occurred as a result of
performance or failure to perform under this Agreement caused by the
acts and /or omissions of any person directly employed by or under the
control or supervision of the CCC while performing the work set forth in
this Agreement.

control or supervision of the Sponsor while performing the work set forth in
this Agreement.

Basically, this provision provides that the CCC will be responsible for its own defense in
actions filed against the CCC and judgments in which the CCC is determined to be
legally responsible. Likewise, the Sponsor will be responsible for its own defense in
actions filed against the Sponsor and judgments in which the Sponsor is determined to
be legally responsible.
The CCC has provided millions of hours of service to public and private entities working
