SUPPLEMENT TO
JOINT EXERCISE OF POWERS AGREEMENT
BETWEEN
CITY OF GILROY AND CITY OF MORGAN HILL
THIS SUPPLEMENTARY AGREEMENT, dated for convenience on June 1, 1983, by
and between the CITY OF GILROY ( "Gilroy "), a chartered city, and the CITY OF
MORGAN HILL ( "Morgan Hill "), a general law city, is intended to supplement and
amend the joint exercise of powers agreement between the same parties relating
to Joint Wastewater Management Facilities.

"Each city shall be responsible to provide and enforce its own pre- treat-
menu program. The monitoring of said program and the review of program changes
shall be the responsibility of the individual cities.

The treatment plant staff will be_responsible for the sampling and testing,
as required, for both cities, however the City of Morgan Hill reserves the right
to make other arrangements for testing at its discretion. Results of all pre-
treatment program testing shall be reported to both cities. Advance notice will
be given when sampling is performed within the City of Morgan Hill so that its
staff may be in attendance. Costs for said sampling and testing shall be
recovered in portion to the services rendered. .

Each city shall cooperate with the other to facilitate the smooth operation
of the Pretreatment Programs. Furthermore, each city shall have the right to
inspect pretreatment program documents of the other. A request for such inspection
may be made either directly to the city or through the Joint Powers Sewer Advisory
Committee.
IV
The Joint Powers Sewer Advisory Committee shall have the right to
request either city to immediatel.y halt an industrial user's wastewater
discharge to the wastewater system and /or treatment plant. In the case
of an imminent danger to either the Wastewater System or the Treatment
Plant, the Joint Sewer Advisory Committee, meeting on an emergency basis,
and with a 4/5 vote, can authorize the treatment plant personnel to shut
off an industrial user's wastewater in either City.
V
All other provisions of the Original Agreement shall remain in full
force and effect upon execution of this Supplemental Agreement.
