This agreement is entered into on April 15, 2014, between Michael A. Gaeta, the owner
of certain improved real property located at 7451 Monterey Street, Gilroy, CA and the City of
Gilroy.
The City holds title to that certain adjacent real property located at 7453 Monterey Street,
Gilroy, CA.
The City is making certain improvements to the 7453 Monterey Street property, some of
which include hardscape, landscaping, light poles, underground utilities, drainage and storm
water infrastructure; foundations for improvements such as seat walls, lighting, a gate (spanning
between the two existing buildings on the License Property), etc.; electrical conduit and wiring;
irrigation and other water infrastructure; etc., along with support posts and interpretive display
boards.
The City and the owner of 7451 Monterey Street, Michael Gaeta, are working on a
formal agreement to allow for installation of long -term improvements, as noted above, on Mr.
Gaeta's property, and said agreement shall supersede this agreement, should it be formally
agreed upon.
Mr. Gaeta agrees to allow initial construction on his property to begin for the purposes
outlined above, such as hardscape, landscaping, light poles, underground utilities, drainage and
storm water infrastructure; foundations for improvements such as seat walls, lighting, a gate
(spanning between the two existing buildings on the License Property), etc.; electrical conduit
and wiring; irrigation and other water infrastructure; etc., along with support posts and
interpretive display boards. Said initial construction will include but is not limited to at -grade
and sub -grade work, as well as removal of an existing chain -link fence on Mr. Gaeta's property.
