This Agreement is entered into between the State Agency and Contractor named below: STATE AGENCY'S NAME California High-Speed Rail Authority (Authority) CONTRACTOR'S NAME City of Gilroy 2. The term of this Agreement is: July 1, 2014 through December 31, 2017 3. The maximum amount of this $600,000.00 Agreement after this amendment is: Six Hundred Thousand Dollars and Zero Cents 4. The parties mutually agree to this amendment as follows. All actions noted below are by this reference made a part of the Agreement and incorporated herein: STD213, Section 2 is amended to extend the term twelve (12) months and shall read as follows: "The term of this Agreement is July 1, 2014 through December 31, 2017" Exhibit A, Scope of Work-, Section, Phase II. Development of Station Area Plan, Paragraph 1 is replaced in its entirety and shall read as follows: "Phase II will include the completion of a HST Station Area Plan for the City Council's preferred station site. If the City Council preferred station site is at/near the existing downtown Caltrain station (Downtown Station), that City Council preference will coincide with the FBA's (2008) and Authority's (2012) environmental program -level preferred station location. The City recognizes, however, that the Authority and FRA have not made an environmental project -level decision for construction and operation of a Downtown Station (and that the Authority and FRA project -level environmental document may carry a non - Downtown Station alternative together with the Downtown Station alternative), but is willing to proceed with Phase II nevertheless. The Authority believes that Phase 11 efforts will help inform the Authority's (and FRA's) project -level decisions as to the extent to which a Downtown Station location will meet the Authority's and FBA's goals of minimizing sprawl, reducing VMT, promoting transit, etc., given that local agencies such as the City, and not the Authority or FRA, control local land use. " Exhibit B, Attachment 2, Budget is replaced in its entirety and is attached hereto. All other terms and conditions shall remain the same.
