HomeMy WebLinkAboutGUSD - MOU for School Resource Officer (2019)OF ..G/`7351 Rosanna Street eftp of Offrop Gilroy,California • 1 1 • • O�-TED MARG� Date: May 21, 2019 Telephone (408) 846-0491 Facsimile (408) 846-0500 httiD://www.ci.ailrov.ca.us Subject: Memorandum of Understanding (MOU) between Gilroy Unified School District ("GUSD") and the City of Gilroy ("City") (which may be referred to hereinafter individually as a "Party" and collectively referred to hereinafter as the "Parties") to provide fiscal support for the School Resource Officer ("SRO") assigned to GUSD. Purpose: GUSD and the City desire to place two SRO's in service to the GUSD. The City and GUSD have agreed that each entity will provide 50% of the funding necessary to pay the full cost of the SRO positions for the GUSD 2019-2020 fiscal year. The purpose of this MOU is to confirm this cost -sharing arrangement and to set forth the agreed upon terms in order for the City of Gilroy to provide the GUSD with two SRO officers for the 2019- 2020 school year. Terms of MOU: 1. The Parties have agreed that as a condition to the City providing the GUSD with two SROs for the 2019-2020 school year (9 months), GUSD will share the cost and cover 50% of each officer's full annual salary for the 2019-2020 GUSD fiscal year, as calculated by the City, including overtime and related benefits. The cost will be based upon the salary and benefits that each officer assigned to the GUSD would receive for performing their regular patrol duties, as described in the cost summary in "Attachment A" to this agreement. The City will provide funding for the remainder 50% cost of the SRO position. The GUSD's share of the cost will apply to the SROs on -campus duties,. as well as the officers' regular patrol duties, as determined by the Gilroy Police Department, performed during and outside of the 2019-2020 school year. 2. At the end of the term of this MOU (as defined below) the City will provide the GUSD with an annual invoice for the GUSD's share of the cost for the two SROs. The full annual salary of the two SROs, excluding overtime pay, is $473,713.67. GUSD's portion of the cost, not including overtime pay is estimated to be $236,856.83. The City will provide the GUSD with the balance due for overtime pay with its annual invoice. 4847-2684-8663v2 CCHUk04706098 3. The SROs are not employees of the GUSD and will at, all times during the term of this MOU remain under the direct command of the Gilroy Police Department. The City and its Police Department will supply all necessary equipment for the SROs for the performance of their SRO duties. The officers may on an emergency basis be called away from their on -campus duties to perform regular duties during GUSD school operational hours, as needed. Should the employment of either or both of the SROs be terminated during the 2019-2020 school year, the City will provide substitute officers, and the GUSD's share of the cost will remain the same and continue to be based on the officers' salaries as calculated per "Attachment A." 4. The term of this MOU will commence on the date of the last party to sign this agreement (the "Effective Date") and will continue in effect through the GUSD 2019-2020 fiscal year, unless sooner terminated in accordance with the termination provisions provided herein. Either Party may terminate this MOU without cause at any time upon giving thirty (30) days written notice to the other Party. 5. This MOU may be renewed for the 2020-2021 school year if GUSD and the City can provide their respective 50% funding levels. The City and GUSD agree to determine by April 30, 2020 whether the position will be renewed for an additional school year.
