The undersigned, being first duly sworn, deposes and says: That at
all times hereinafter mentioned affiant was and still is a citizen of
the United States, over the age of eighteen years, and not a party
to or interested in the above entitled proceedings; and was at and
during all said times and still is the principal clerk of the printer and
publisher of the San Jose Mercury News, a newspaper of general
circulation printed and published daily in the City of San Jose,
County of Santa Clara, State of California as determined by the
court's decree dated June 27, 1952, Case Numbers 84096 and
84097, and that said San Jose Mercury News is and was at all
times herein mentioned a newspaper of general circulation as that
term is defined by Sections 6000; that at all times said newspaper
has been established, printed and published in the said County and
State at regular intervals for more than one year preceding the first
publication of the notice herein mentioned. Said decree has not
been revoked, vacated or set aside.
I declare that the notice, of which the annexed is a true printed
copy, has been published in each regular or entire issue of said
newspaper and not in any supplement thereof on the following

NOTICE OF PUBLIC HEARING
GILROY CITY COUNCIL I MONDAY, AUGUST 15, 2022
NOTICE IS HEREBY GIVEN that the City Council of the City of Gilroy, on
Monday, August 15, 2022, will hold a public hearing commencing at
Gilroy City Council Chambers, 7351 Rosanna Street, Gilroy, CA, at 6:00
PM, or as soon thereafter as possible, to consider the following item(s):
The City Council Consideration of: (1) the adoption of an urgency
ordinance entitled, "An Urgency Ordinance of the City Council of the
City of Gilroy Adopting a Short -Term Interim Franchise Agreement
with Recology South Valley for Solid Waste Hauling Services"; and (2)
a finding that its action in adopting the ordinance is exempt from re-
view under the California Environmental Quality Act ("CEQA") pur-
suant to CEQA Guidelines Section 15061(b)(3) (Common Sense Ex-
emption) in that the proposed ordinance will continue an existing
state -mandated program for the protection of public health and the
environment, and none of the circumstances in CEQA Guidelines
Section 15300.2 applies.
NOTE: Interested parties are encouraged to attend this public hearing
as this is the time and place when comments on the proposals shall be
heard and given due consideration. If you challenge the adequacy of
the subject proposed actions in court, you will be limited to raising on-
ly those issues or alleged inadequacies which you presented to the
City Council orally or in writing at or prior to the public hearing. You
may not be entitled to maintain a legal action against the proposed ac-
tion unless you object to it, orally or in writing, at or prior to the public
hearing.
Persons who are unable to attend this public hearing may submit writ-
ten comments by email to the project planner noted below, or by deliv-
ering them to the Administration Department at City Hall, 7351 Rosanna
St. Gilroy, CA. 95020 prior to, or at the public hearing to be incorporated
into the record. If you challenge the decisions at this hearing, you may
be limited to raising only those issues you or someone else raised at
the hearing, described in this notice, or in written correspondence de-
livered to the City at or prior to the meeting.
Detailed description of this proposal is on file with the Administration
Department. The staff report for this proposal may be viewed on the
city website (www.cityofgilroy.org) by 5:00 pm the Thursday before the
