NOTICE IS HEREBY GIVEN that the City Council of the City of Gilroy, on Monday, November
21, 2022, will introduce an ordinance and will consider the adoption of the proposed ordinance on
Monday, December 5, 2022, the title of which is:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GILROY ADOPTING A
FRANCHISE AGREEMENT WITH RECOLOGY SOUTH VALLEY FOR SOLID WASTE
HAULING SERVICES AND A FINDING THAT ITS ACTION IN ADOPTING THE
ORDINANCE IS EXEMPT FROM REVIEW UNDER THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT (“CEQA”) PURSUANT TO CEQA GUIDELINES
SECTION 15061(B)(3) (COMMON SENSE EXEMPTION) IN THAT THE PROPOSED
ORDINANCE WILL CONTINUE AN EXISTING STATE-MANDATED PROGRAM FOR
THE PROTECTION OF PUBLIC HEALTH AND THE ENVIRONMENT, AND NONE OF
THE CIRCUMSTANCES IN CEQA GUIDELINES SECTION 15300.2 APPLY
SUMMARY OF ORDINANCE:
This ordinance would adopt a franchise agreement with Recology South Valley, including
terms and conditions, for refuse, recycling, and organics recycling services for the City of
Gilroy, including implementation of new and required California solid waste regulations.
Reading the entire ordinance is necessary to obtain a full understanding of its provisions
of this ordinance. A certified copy of the full text of the proposed ordinance is available
for public review in the Office of the City Clerk at Gilroy City Hall, 7351 Rosanna Street,
