August 6, 2020 Regular Meeting Minutes V. PUBLIC HEARINGS A. Staff has analyzed the proposed project, and recommends that the Planning Commission: Adopt a resolution upholding the original approval of Eagle Ridge Drive Landscaping MM 20-19 (20060007), subject to certain findings and conditions. 1. Staff Report: Phil Angelo, Planning Technician 2. Public Comment 3. Planning Commission Disclosure of Ex-Parte Communications 4. Possible Action: Planning Technician Angelo presented the report. Chair Fischer opened public comment. Planning Technician Angelo read the received email comments into the record. Chair Fischer closed public comment. The Commission considered a motion to adopt a resolution upholding the original project approval and denying the appeal, but the motion failed. RESULT: DENY [1 TO 6] MOVER: Peter Fleming, Planning Commissioner SECONDER: Reid Lerner, Planning Commissioner AYES: Fleming NAYS: Lerner, Estorga, Morales, Doyle, Kim, Fischer Staff has analyzed the proposed project, and recommends that the Planning Commission: Adopt a resolution upholding the original approval of Eagle Ridge Drive Landscaping MM 20-19 (20060007), subject to certain findings and conditions. 1. Staff recommends that the Planning Commission conduct a public hearing to discuss the proposed ordinance and send the matter back to staff to allow adequate time to conduct stakeholder outreach, allow legal review, and make appropriate language refinements and adjustments. 1. Chair Fischer opened the public comment. Chair of the Bicycle and Pedestrian Commission Hilton commented in support of the ordinance. Gary Walton, President, and John Taft, Treasurer commented in support of the ordinance. Chair Fischer closed the public comment. The Commission accepted the report and take no further action. NEW BUSINESS- NONE VII. INFORMATIONAL ITEMS A. August 10, 2020 Planning Division Current Project Log No report on the item and no questions by the commissioners. VIII. REPORTS BY COMMISSION MEMBERS Vice Chair Casey Estorga reported on the High Speed Rail Authority. No meeting but the commissioner provided an update that the rail is currently anticipated to come to Gilroy around 2030 - 2034. IX. PLANNING DIVISION REPORT Kraig Tambornini presented the report. The 2040 General Plan Environmental Impact Report comment period has closed. The High Speed Rail Environmental Impact Report comment period has also closed. In September the High Speed Rail Authority should adopt their preferred rail alignment. CEQA traffic analysis is being updated to use Vehicle Miles Traveled instead of Level of Service. The updated Accessory Dwelling Unit Ordinance is effective as of August 5, 2020. Our ordinance is currently being reviewed by the state Housing and Community Development The City Council adopted the updated Historic Resources inventory and directed staff to do additional outreach to effected property owners. No items are currently scheduled for the September 3, 2020 meeting. The 2040 General Plan Environmental Impact Report review is scheduled for the October 1, 2020 meeting. X. ASSISTANT CITY ATTORNEY REPORT The California Fair Political Practices Commission is implementing a new regulation 18707 which will be effective on August 22, 2020. The regulation requires public officials to identify if they have a conflict of interest for an agenda item even if they have left the meeting prior to the agenda items consideration, or if they arrive after the agenda items consideration.
