RESOLUTION 2025-01
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY APPROVING THE SECOND AMENDMENT TO THE
AGREEMENT FOR MAINTENANCE OF STATE
HIGHWAYS IN THE CITY OF GILROY AND
AUTHORIZING THE CITY ADMINISTRATOR TO
EXECUTE THE AMENDMENT
WHEREAS, an “Agreement for Maintenance of State Highways in the City of
Gilroy”, hereinafter referred to as “AGREEMENT”, as provided for in Section 130 of the
Streets and Highways Code, was executed by STATE on February 2, 1990; and
WHEREAS, PARTIES executed the First Amendment to AGREEMENT on August
22, 2012, to modify Section H of AGREEMENT and EXHBIT A of AGREEMENT; and
WHEREAS, AGREEMENT by its terms provides that it may be amended or
terminated at any time upon mutual consent of PARTIES; and
WHEREAS, CITY requested STATE to delegate maintenance and operation
responsibilities for traffic signals, pedestrian hybrid beacons (PHBs), and rectangular
rapid flashing beacons (RRFBs) on State Highway Route 152 (SR 152) between State
Highway Route 101 and the westerly city limits in Santa Clara County; and
WHEREAS, the Parties hereto now desire that AGREEMENT be amended.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Gilroy
as follows:
1. That the City Council hereby approves the Second Amendment to the
Agreement for Maintenance of State Highways in the City of Gilroy.
2. That the City Administrator or his designee is hereby authorized and directed
to sign all necessary documents on behalf of the City of Gilroy, and the City
Clerk is hereby authorized and directed to attest the signature of the City
Administrator on the Second Amendment to AGREEMENT to modify Section
H of AGREEMENT and EXHIBIT A of AGREEMENT.
3. That a true copy of said Second Amendment to AGREEMENT is attached
hereto and incorporated herein by reference.
