(Roll Call Vote) BACKGROUND: Subject Property and Surrounding Land Uses: The 0.22-acre subject site is located in the Downtown Expansion District (DED) and is currently improved with a historic home and a non -historic garage. The upper level of the home is currently used as a residential unit, and the lower level, currently vacant, has been various commercial uses in the past. The property has been under a Historic Property Preservation Agreement effective January 1, 2007, through the approval of Mills Act application MA 06-04 (#0608002). This use is classified as a bar; therefore, per 30.19.10 of Gilroy City Code, a CUP is required. Additionally, the establishment would need to acquire an ABC license from the State afte r the subject CUP application gets approval. The applicant has indicated that she will seek an ABC Type 40 Beer license which authorizes the sale of beer for consumption on or off the premises. With this type of license, no wine or distilled spirits are permitted on the premises. Full meals are not required; however, sandwiches or snacks must be available. Minors are allowed on the premises. The applicant has further indicated that guests are encouraged to bring their own food or can purchase items from a small menu that features food items from restaurants in the area. The applicant would obtain inventory from local breweries which will eliminate the impact created by large delivery vehicles. Guests will only be allowed to consume beer within the designated area inside the tap house and within the gated patio. Signage will be placed around the patio and entrances indicating where beer may and may not be consumed. Environmental Assessment: Section 15301(Existing Facilities) of the California Environmental Quality Act (CEQA) Guidelines, exempts the proposed project from further environmental review, so long the project involves utilizing the existing facility with minimal interior or exterior alterations. Bitter Tap House proposes to utilize the existing historic home with minimal building and onsite improvements. No exterior building modifications are proposed. Filing of a Notice of Exemption (NOE) is not mandated, however, it would reduce the statute of limitations for legal challenges under CEQA, from 180 days to 35 days. No further assessment is necessary for this proposal. ANALYSIS: 5.A Packet Pg. 10 3 General Plan Consistency: The City’s General Plan designated the subject site for Downtown uses, which supports the proposed project request. As such, the proposa l conforms to the goals and policies of the General Plan. Key goals and policies, which pertain to the proposed project, are discussed below: Conformance with Zoning Code Development Standards: The proposed development is located in the Downtown Expansion District (DED) zone. In accordance with the Gilroy City Code (GCC), the proposed Beer Garden may be permitted with an approved Conditional Use Permit. Applicable development standards for the project have been considered for the proposed project, as follows: Outdoor Use: The proposed beer garden consists of an outdoor seating are a. Per Section 30.50.41 of the Gilroy City Code, an Architecture and Site Review (AS) application is required with the establishment of an outdoor use. The applicant has submitted AS 19-23 (#19110032) which proposes the creation of an outdoor sitting area where beer consumption will take place. This application will be analyzed by Planning Staff to ensure conformance with all applicable code requirements. The approval of AS 19-23 will be contingent on the approval of the subject Conditional Use Permit request. Parking Requirements: The existing historic home has a two-car garage and one accessible parking space in front of the garage. Since it was originally a residential use, no additional parking spaces have been provided on-site. Eleven parking spaces exist fronting the site on the public street on Second Street and Monterey Street, in both angled and parallel parking configurations. No additional on-site parking spaces are proposed with the project. Based on the scope of the proposed use, the parking requirements are as follows: Parking requirements: Required Spaces Per Use Proposed Required 1 space / 6 seats 50 seats 8.33 1 space / 4 employees 4 employees 1 POLICY # TITLE AND SUMMARY ANALYSIS 1.02 Mix of Uses. Create a diverse mix of land uses. The project creates an outdoor atmosphere that is lacking in this portion of downtown. 3.02 Actively promote economic activity. The project creates economic activity, not only for the applicant, but for the surrounding restaurants and other businesses. The beer garden will have a small menu that features food from local restaurants. 5.A Packet Pg. 11 4 1.5 spaces / residential unit > 800 sq. ft. 1 residential unit 1.5 1 space/ every 4 units, guest parking 1 residential unit 0.25 Total: 11.08 Historic Exemption: -25% Total: 8.31 Rounded Total: 8 The proposed project requires eight (8) off-street parking spaces after California Health and Safety Code 18962.a.2 has been applied; which gives a 25-percent reduction in the amount of required parking spaces for a project re-adapting a designated historical resource. Based on previously approved commercial uses including a retail use at the site, the Planning Division has determined that the site currently has six (6) “grandfathered” spaces; therefore the applicant is only required to provide two (2) off-street spaces. Additionally, on January 31, 2020, the applicant submitted an application for Minor Deviation 20-01 (VMD 20-01). The application requests a minor deviation pursuant to section 30.50.20.b of the Gilroy City Code, and under this provision the Community Development Director can waive up to four (4) required parking spaces. The applicant is requesting an additional parking reduction of one (1) space. If VMD 20-01 is approved; the applicant will need to provide only one (1) off -street parking space for the proposed use. Due to preservation efforts of the historic integrity of the subject property, previous approvals of commercial uses requiring no addition of parking spaces, and amount of available on -street parking in the vicinity; staff is recommending approval, to the Community Development Director of the minor deviation. The approval of VMD 20-01 will be contingent on the approval of this Conditional Use Permit. The property owners directly adjacent to the subject site were notified of the Minor Deviation request. At the time writing this staff report, one person expressed concern about the lack of parking, but did not leave their name or contact information for follow-up. Signage: The applicant has submitted sign application SP 19 -40 (#19110034). This application will be reviewed by Planning Staff to ensure conformance with all applicable requirements set in section 30.37.50 of Gilroy City Code. Technical Advisory Committee (TAC): Project plans were routed to the TAC, made up of representatives from the Engineering Division, Building Division, Police Department, and Fire Department for internal review and comment. The TAC 5.A Packet Pg. 12 5 considered the project on December 4, 2019. Recommendations of the TAC members have been incorporated into the project plans and/or are included as recommended conditions in the attached resolution. Noticing: Property owner information (i.e. list, labels, and map) within 500 feet of the subject site were generated by The County of Santa Clara using current ownership data. On February 18, 2020, notices for the Planning Commission meeting were mailed to the property owners along within other interested parties. In addition, the property has been posted with on-site signage notifying passersby of pending development, and the Planning Commission public hearing packets are available through the City's webpage. Appeal Procedure: In accordance with Section 30.51.50 of the Gilroy City Code, the Planning Commission's decision may be appealed, in writing, to the City Council within 20 days of adoption of the resolution. Appeal forms may be obtained from the City Clerk and must be submitted with the appropriate fee before the end of the appeal period. As such, staff supports a recommendation of approval by the Planning Commission with the recommended conditions included in Attachment “C” of this staff report. WHEREAS, Larissa Dickerson, on behalf of Bitter Tap House, submitted CUP 19-01 on November 27, 2019, requesting approval of a Conditional Use Permit to operate an indoor/outdoor alcohol consumption establishment in an existing approximate 1,988 square foot building; and WHERAS, the subject property is zoned as Downtown Expansion District; and WHERAS, an indoor/outdoor alcohol consumption establishment may be permitted with a Conditional Use Permit within the Downtown Expansion District; and WHEREAS, said Conditional Use Permit application was referred to the Technical Committee for recommendations on December 4, 2019; and WHEREAS, no further environmental analysis is required by the California Environmental Quality Act (CEQA) pursuant to Section 15301 (Existing Facilities) of the CEQA Guidelines; and WHEREAS, on March 12, 2020, the City of Gilroy Planning Commission held a duly noticed public hearing where the application materials, staff report, and public testimony were considered; and WHEREAS, the location and custodian of the documents and other material which constitute the record of proceedings upon which this Project approval is based is the official of the Community Development Department; and WHEREAS, the Planning Commission of the City of Gilroy has considered the Conditional Use Permit application (CUP 19-01), in accordance with the Gilroy Zoning Ordinance, and other applicable standards and regulations; and WHEREAS, the Planning Commission finds the Conditional Use Permit conforms to the City's General Plan and elements thereof; and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, the following: 5.A.c Packet Pg. 17 Attachment: Resolution of Approval, CUP 19-01 (2650 : Bitter Tap House Beer Garden Conditional Use Permit) Resolution No. 2020-XX 2 CUP 19-01 (A) That the proposed use is properly located in relation to the general plan and to the community as a whole and to other uses and to transportation and service facilities in the vicinity. WHEREAS, the Planning Commission finds that the applicant agrees with the necessity of and accepts all elements, requirements, and conditions of this resolution as being a reasonable manner of preserving, protecting, providing for, and fostering the health, safety, and welfare of the citizenry in general. NOW THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Gilroy hereby grants approval of the Conditional Use Permit application, subject to the following conditions: GENERAL PROJECT CONDITIONS 1.
