RECOMMENDATION: Adopt a resolution recommending to the City Council approval of Tentative Map application TM 20-02. (Roll Call Vote) BACKGROUND: Subject Property and Surrounding Land Uses: The subject site is currently developed with a 35,626 square foot vacant retail building, formerly Orchard Supply Hardware store. The land use characteristics of the site and adjacent land uses are as follows: LOCATION EXISTING LAND USE GENERAL PLAN ZONING Project Site Commercial building General Services C3 North Warehouse/Storage Yard General Services CM South Shopping Center General Services C3 East Retail, Wells Fargo Bank Downtown DED West Shopping Center, Grocery General Services C3 Environmental Assessment: Section 15315 of the California Environmental Quality Act (CEQA) Guidelines, exempts projects involving minor land divisions from further 5.A Packet Pg. 8 2 environmental review. Thus, no further assessment is necessary for this proposal, and a Notice of Exemption may be filed for the project which reduces the statute of limitations for legal challenges under CEQA, from 180 days to 35 days. Proposed Use: The applicant proposes to create a new parcel in order to allow the property to be sold and/or leased for commercial development. The site of the new parcel has been approved for development of a new 7,022 square foot retail store for O’Reilly’s Auto Parts (AS 19-14), and a building permit has been filed to construct the building. Approval AS 19-14 anticipated a future lot split of the property, as proposed. ANALYSIS: General Plan Consistency: The 2040 General Plan designates the site for General Services land use, which anticipates commercial development of the property. The lot split is consistent with the land use designation and promotes the goals and policies of associated with the underlying land use designation . Tentative Map Analysis: Gilroy Municipal Code Chapter 21 requires Planning Commission review and City Council approval of all tentative map requests. This application has been reviewed by all City departments and utility agencies. Based on this review, a Parcel Map has been prepared and signed by the owner. Upon receiving the Planning Commission recommendation, City Council can approve the map or could request further review by the Planning Commission. A Tentative Map shall be approved unless the parcel would not comply with zoning or subdivision regulations or is located within a severe flood hazard area. There are no minimum lot size or area requirements established by the C3 zoning district table, Section 30.189.20(c)(1). In this case, the 0.788 -acre parcel size and shape will accommodate the anticipated and permitted commercial development of the property, with access to utilities and infrastructure required to support the project, and the site is not subject to undue flooding or inundation . Further, if the approved development plan is not pursued, the site could be developed with another retail commercial use. Tentative map approvals are valid for an initial 24 months and may be extended 3 times for an additional 12 months each. In this case, upon City Council approval, Engineering will complete the process of signing and recording of the attached Parcel Map. FINDINGS: Staff supports a recommendation for approval by the Planning Commission to the City Council of TM 20-02, as shown in the attached Parcel Map. T he following findings are recommended in support of the tentative map request: a) The proposed Tentative Map is consistent with the intent of the goals and policies of the City's General Plan in that it would result in a new commercial lot that will accommodate commercial development as anticipated wit hin the General Services land use designation. b) The proposed development is consistent with the Zoning Ordinance and the 5.A Packet Pg. 9 3 City's Subdivision and Land Development Code, and the State Subdivision Map Act given that the size, shape and location of the property complies with all applicable codes and ordinances. c) Public utilities and infrastructure improvements needed in order to serve the proposed project are in proximity to the site. d) There will be no significant environmental impacts as a result of this project which qualifies for a CEQA Guidelines Class 15, Section 15315 exemption which applies to minor land divisions. Noticing: At least 10 days prior to the hearing all property owners within 500 feet of the subject site were notified, and a notice was published in the Gilroy Dispatch. In addition, the property has been posted with on-site signage notifying passers-by of pending development. The Planning Commission public hearing packet also has been published and made available through the City's webpage at least 72 hours prior to the meeting. No comments have been received as of the completion of staff’s report. Appeal Procedure: The Planning Commission's action is not final. The project will be considered by the City Council at a future date. However, if the developer is dissatisfied with any action of the Planning Commission, an appeal to the City Council can be made. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Gilroy hereby find as follows: FINDINGS 1. The proposed Tentative Map is consistent with the intent of the goals and policies of the City's General Plan in that it would result in a new commercial lot that will accommodate commercial development as anticipated within the General Services land use designation. 2. The proposed development is consistent with the Zoning Ordinance and the City's Subdivision and Land Development Code, and the State Subdivision Map Act given that the size, shape and location of the property complies with all applicable codes and ordinances. 3. Public utilities and infrastructure improvements needed in order to serve the proposed project are in proximity to the site. 4. There will be no significant environmental impacts as a result of this project which qualifies for a CEQA Guidelines Class 15, Section 15315 exemption which applies to minor land divisions.
