of 12 copies of materials should be provided to the City Clerk for distribution to the Council and
Staff. Please limit your comments to 3 minutes.
In compliance with the Americans with Disabilities Act, the City will make reasonable
arrangements to ensure accessibility to this meeting. If you need special assistance to participate

A Closed Session may be called during this meeting pursuant to Government Code Section
54956.9 (d)(2) if a point has been reached where, in the opinion of the legislative body of the City
on the advice of its legal counsel, based on existing facts and circumstances, there is a
significant exposure to litigation against the City.
Materials related to an item on this agenda submitted to the City Council after distribution of the
agenda packet are available for public inspection with the agenda packet in the lobby of
Administration at City Hall, 7351 Rosanna Street during normal business hours. These materials
are also available with the agenda packet on the City website at www.cityofgilroy.org subject to
Staff’s ability to post the documents before the meeting.
The City Council meets regularly on the first and third Monday of each month, at 6:00 p.m. If a
holiday, the meeting will be rescheduled to the following Monday, with the exception of the single
meeting in July which lands on the first day of the month not a holiday, Friday, Saturday or
Sunday.

Proclamation of the City of Gilroy
WHEREAS, Sexual Assault Awareness Month is intended to draw
attention to the fact that sexual assault affects women, children and men of all
racial, cultural and economic backgrounds. The goal of Sexual Assault
Awareness Month is to raise public awareness about sexual violence and
educate communities on how to prevent it; and
WHEREAS, rape, sexual assault, and sexual harassment harm our
community, and statistics show one in five women and one in 67 men will be
raped at some point in their lives; and
WHEREAS, in addition to the immediate physical and emotional costs,
sexual assault may also have associated consequences of post-traumatic stress
disorder, substance abuse, depression, homelessness, eating disorders and suicide;
and
WHEREAS, sexual assault can be devastating not only to the survivor,
but also for the family and friends of the survivor; and
WHEREAS, since no one person, organization, agency or community
can eliminate sexual assault on their own, We must work together to educate
our entire population about what can be done to prevent sexual assault, support
victims/survivors and their significant others and support those agencies
providing services to victims/survivors.
WHEREAS, we join advocates and communities across the country in
taking action to prevent sexual violence.
NOW, THEREFORE, I, Roland Velasco, Mayor of the City of
Gilroy, on behalf of the entire City Council, do hereby proclaim the month of
April as
Sexual Assault Awareness Month
in the City of Gilroy and recognize each day of the year is an opportunity to create change
for the future. I encourage all citizens of the City to learn more about preventing sexual
violence.

III. PRESENTATIONS TO THE COUNCIL
Bill O'Connor detailed his concerns with the costs of the recently approved
swimming pool shade structure bid and presentation of the item.
Mattie Scariot announced the upcoming Poppy Jasper National Film Festival
event being held in Gilroy on April 7th asking if the City would support the
Festival and possibly provide proclamations for the two former Gilroy residents
who worked in the film industry and would be attending the event.
Ron Kirkish shared his concerns with a new County criminal reentry resource
center that was moving to Gilroy from San Martin, asking if the city had any
control over the placement of the facility in Gilroy.
Public comment was then closed.
IV. REPORTS OF COUNCIL MEMBERS
Council Member Tucker reported on the Welcome Center Board of Director's
meeting and the Santa Clara Valley Habitat Agency meeting, and then
announced the Welcome Center wedding expo that would be held at Gilroy
Gardens.
Mayor Pro Tempore Harney announced the upcoming Downtown Association
mixer and thanked staff for putting on a successful City Volunteer dinner. He then
spoke on the Clean Energy Authority meeting explaining that rates were being
reduced on average by 6%.
Council Member Tovar spoke on the recent Chamber mixer and announced the
Youth Alliance spring mixer. He concluded by announcing the Rebekah's
Children's Services fundraising event being held at Sycamore Winery.
Council Member Leroe-Muñoz spoke on the Santa Clara Valley Water District
goals to continue to conserve water as rain levels were still below the historical
average.
Mayor Velasco reported on the recent Economic Development Corporation
meeting. He then thanked Recreation staff for a wonderful volunteer dinner.
V. FUTURE COUNCIL INITIATED AGENDA ITEMS
Council Member Tovar suggested providing a proclamation for the Poppy Jasper
film festival.
Mayor Velasco asked the Council to consider agendizing an item to address a
suspension on limiting only first floor retail requirements in the downtown.
The Council agreed to agendize the item.

Jane Howard spoke on using the adopted style guide for signage in city parks,
and then spoke on use of materials for slides that did not heat up in extreme heat
conditions.
Public comment was then closed.
The item was referred back to staff for further research.
X. INTRODUCTION OF NEW BUSINESS
A. Presentation of 2017 General Plan Annual Report
The item was introduced by City Administrator Gonzalez and further presented
by Senior Planner Ketchum.
Public comment was opened.
Ron Kirkish stated that the LAFCO report was in conflict with the urban growth
boundary sharing concerns with land available for annexation under the urban
growth boundary, and issues with flooding.
Bill O'Connor spoke on the GPAC community workshops explaining that
comments of the community were not considered when the GPAC held their
discussions and set their priorities.

RECOMMENDATION
Approval of the removal of City museum artifacts, and per her request, removal of a
portrait of former Mayor Roberta H. Hughan from the City’s Art collection.
EXECUTIVE SUMMARY
The Gilroy Museum (Museum) was formally established in the basement of the first
Gilroy Public Library in 1963. When the second library was built in 1975, the Museum
moved upstairs and the basement was relegated to storage. At this time, public
donations were accepted regardless of their historical or cultural significance to Gilroy.
Although it had always been the intent of the Gilroy Museum to focus primarily on
“Gilroy and its environs”, a formal Collection Policy reflecting that purpose was not
implemented until 2000.

At present, there is a body of artifacts in the Museum’s collection which have been
stored at either the Museum or the Willey Cultural Center and fit the deaccessioning
criteria utilizing the guidelines from the Museum’s Collection Policy.
Deaccessioning, an accepted Museum practice, is the formal removal of an artifact or
document from a collection. The Gilroy Museum’s Collection Policy outlines criteria for
this purpose. An artifact may be removed for any one of the following criteria:
1. Non-relevance to the Gilroy Museum’s collection focus
2. Condition of an artifact
3. Surplus or duplicate artifacts
4. Acquisition of a better example
Once deaccessioned, the items will be disposed of in a manner that is in the best
interest of the Gilroy Museum, including but not limited to:
1. Auction/Sale
2. Exchange programs with other museums
3. Loans to schools or other institutions
4. Outright disposal if the condition so warrants
Precedent for deaccessioning has been established at the Gilroy Museum with the 2009
sale of the Kaiser Wilhelm commemorative vase. Monies from the sale were placed in
the City of Gilroy’s Museum Endowment Trust Fund. Further, in 2014 the City Council
also approved the deaccession of a series of books and periodicals from the Museum
collection. As further review of the collection proceeds, additional artifacts will be
marked for deaccession and presented to Council in the future. Deaccessioning will
assist in maintaining and preserving the collection and allow it to grow into the 21 st
century.
Among the items to be deaccessioned is a portrait of Roberta H. Hughan. This painting
was gifted to the City of Gilroy on July 23, 2007, by local artist Carol Peters, to be
included in the City’s Art Collection. Roberta H. Hughan has requested that the painting
be removed from the collection, as she would like to gift it to her children.
The attached list of artifacts, consisting of furniture, artwork and the portrait of Roberta
H. Hughan, has been reviewed and recommended for deaccession by the Museum’s
Collection Committee, the Museum Management Team and City of Gilroy staff. The
Gilroy Arts & Culture Commission, the advisory board for the Gilroy Museum, voted
unanimously (4-0-0) to recommend the deaccession of these items at their regular
meeting on February 13, 2018.

Gilroy Museum Deaccession List:
The Parker Furniture Collection was donated to the Gilroy Museum by Tom and Jan Parker of San Jose,
California, on December 2, 1997. Although the furniture is indicative of a time period, it is not representative
of the local area, nor is it reflective of the current Collection Policy. Several attempts were made to contact the
Parkers without success, and it has been concluded that they have moved from the area.

at the Gilroy Museum. Mr. Robert H. Morgan Esq., son of the late W. Robert Morgan, Esq., has been notified
of the Museum’s intent and is in agreement with the decision to deaccession the paintings.

Gilroy Museum
Collection Policy
The Gilroy Museum was established to collect, conserve and interpret the history of the City of
Gilroy and its environs.
Museum Collections are used for exhibition, research and educational purposes. Acceptable
material will consist of artifacts of cultural, historical, or technological significance to the history
of the City of Gilroy and its environs. The Museum reserves the right to determine when or how
such material will be used. Because the Museum has a flexible exhibition policy for educational
and preservation purposes, artifacts on display can be expected to change.
Archive Collections are comprised by materials whose primary purpose is research. Acceptable
material will generally relate to documentation of the history of Gilroy and its environs and will
include manuscript and printed records, photographic negatives and materials, prints, maps and
other historical source materials. The Museum’s library materials are available to the public for
use on the premises.
Literary Rights: Unless otherwise restricted by copyright or by the donor and agreed to by the
Gilroy Museum at the time of acquisition, all literary rights are conveyed to the Museum. The
Museum’s library can assume no responsibility for misuses of literary or copyright restrictions
by users of unrestricted material beyond normal professional library ethics and standards.
Gifts to the Museum and its library are considered outright and unrestricted donations to be used
in the best interest of the Gilroy Museum. Usually, accepted gifts are considered extremely
important or the best available at the time acquired. However, no individual or institution can
neither predict nor govern the changing attitudes of future generations, nor guarantee
permanency beyond the best available preservation procedures.
It is sometimes impractical to evaluate all material at the time of acquisition. Upon evaluation,
some material may be declared expendable by acquisition of better examples. Expendable
material includes surplus, duplicate, non-relevant, or material of deteriorated condition or limited
use. Such material will be used in the best interest of the Gilroy Museum, including, but not
limited to, exchange programs to acquire other needed materials, loans to schools or other
institutions, auction, or outright disposal if the condition or value so warrants. Any material
declared expendable must be approved by the Recreation Director, the City Administrator and
the Arts & Culture Commission, subject to final approval by the Gilroy City Council.
Donations may be tax deductible. However, the Gilroy Museum cannot appraise donations for
tax purposes. For the protection of the donor it is recommended that such appraisals be done by a
disinterested third party before title to the material is conveyed to the Gilroy Museum.

WHEREAS, Gilroy is proud to honor as one of our most esteemed citizens,
Randy Spendlove, Graduate of Gilroy High School, President of Paramount Motion
Picture Music, Accomplished American music producer, songwriter, Grammy Award
winner, and film industry executive.; and
WHEREAS, Randy started at A&M Records as VP of Promotions where he
worked with artists such as Janet Jackson, Sheryl Crow, Soundgarden, and Bryan
Adams. In 1998, he became President of Motion Picture Music at Miramax Films
where he worked on Chicago, Shakespeare in Love, Cold Mountain and Finding
Neverland; and
WHEREAS, Randy Spendlove won a 2004 Grammy for Best Soundtrack
Album for a Motion Picture for Chicago. He co-supervised the music and co-produced the
soundtrack album for Dreamgirls, which was nominated for three Academy Awards.
Randy Spendlove also serves on the board of the Society of Young Composers, and mentors
young composers and musicians at UCLA and USC and is a member of the Board of
Governors for the Recording Academy; and
WHEREAS, Randy Spendlove has been honored with numerous awards and
recognitions. In 2011, Randy was honored by the T.J. Martell Foundation and was the
recipient of its "Humanitarian Award." Additionally, in 2007, Randy received the
"Joseph Papp Racial Harmony Award" from the Foundation for Ethics; and
WHEREAS, it is Gilroy’s honor to recognize Randy Spendlove for his
commitment to the advancement of film and digital media arts, and for his generosity in
sharing his inspiring story with the people of Gilroy as special guests of the 2018 Poppy
Jasper International Film Festival.

WHEREAS, Gilroy is proud to honor as one of our most esteemed citizens,
Kevin Rubio, Graduate of Gilroy High School, Accomplished Writer, Producer, and is
known for films such as Troops (1997), Shelf Life (2011) and Hashtag (2016); and
WHEREAS, Kevin Rubio made his directorial debut at the age of 17 with a stage
adaptation of Robert Redford’s Ordinary People, then spent the next two years directing
musical theater in such productions as You’re a Good Man Charlie Brown and Joseph
and the Amazing Technicolor Dreamcoat, earning several awards for these productions;
and
WHEREAS, From 1984 - 1988, Kevin Rubio apprenticed in the field of
lighting, set design, and directing under George Costa, director of the San Jose Civic Light
Opera House; and
WHEREAS, Kevin Rubio also wrote a number of humorous character interviews
for Star Wars Insider. More recently, Rubio wrote an episode of Star Wars: The Clone
Wars called Bombad Jedi; and
WHEREAS, In 2006 Kevin Rubio was inducted into the 501st Legion as an
honorary member during the 501st dinner at Comic-Con International in San Diego; and
WHEREAS, Kevin Rubio is an acclaimed writer and promotion producer, and
has written comic books for Dark Horse's successful Star Wars Tales line; and
WHEREAS, it is Gilroy’s honor to recognize Kevin Rubio for his commitment to

RECOMMENDATION
Receive report and provide direction to staff.
BACKGROUND
The City has 15 standing Boards, Commissions and Committees (policy bodies) with
member appointments made by the City Council. Several of these policy bodies have
instituted attendance regulations within their bylaws or standing rules. Others do not
have bylaws and simply follow the City Charter. This report identifies these particular
attendance standards and will provide a variety of options with regards to standardizing
attendance throughout all appointed policy bodies.
Article 9, section 900 of the City Charter speaks to vacancies of the City Boards and
Commissions, describing that if a member absents themself from three (3) consecutive
regular meetings without permission of such board or commission expressed in its
official minutes, their office shall become vacant.
Five of the city policy bodies have bylaws that expand on the Charter attendance
standards by setting rules for reporting absences, as follows:

Bicycle Pedestrian Commission:
1. Whenever a member of the BPC has missed three (3) consecutive regular meetings
without permission of the BPC as expressed in its official minutes, their office shall
become vacant. Absences will be deemed as excused and recorded in the BPC
minutes only if the BPC secretary is notified forty-eight (48) hours in advance of the
meeting.
Community Neighborhood Revitalization Committee:
1. CNRC members are expected to attend all meetings of the CNRC. Pre-planned
absences shall be reported to the Secretary of the CNRC at least two (2) hours, or
as soon as possible in unexpected situations.
Personnel Commission:
1. Personnel Commission members are expected to attend all meetings of the
Personnel Commission. Pre-planned absences shall be reported to the Secretary
of the Personnel Commission at least forty-eight (48) hours prior to the meeting
date.
Planning Commission:
1. Any member of the Commission who knows he/she will not be able to attend a
scheduled meeting shall notify the Planning Division at the earliest possible
opportunity and, in any event, prior to 4:00 p.m. on the date of the meeting, stating
the reason for the absence. The secretary will report said notification to the
Commission, and unless there is an objection by the Commission, an absence with
prior notification will be deemed excused and so recorded in the minutes of the
meeting.
Youth Commission:
1. Absences will be deemed as excused and recorded in the Commission's minutes
only if the Commission advisor or Chairperson is notified forty-eight (48) hours in
advance of the meeting.
The rest of our city policy bodies simply follow the Charter with regards to attendance,
with no particular rules for notification of an absence to deem it excused or unexcused.
A comprehensive listing of member attendance of all policy bodies is included as an
attachment. As seen in this listing several of our policy bodies have experienced
difficulty in maintaining a quorum at their meetings due to member attendance. Some

policy bodies which hold meeting quarterly or less than once a month have encountered
issues with members missing more than 50% of their meetings.
ANALYSIS
Current practices
Many of the staff liaisons to our city policy bodies routinely remind the membership of
regular meeting dates and conduct surveys of their members to ensure a quorum will be
present. The staff liaison to the Community & Neighborhood Revitalization Committee
and Housing Advisory Committee sends emails the membership the week prior to the
meeting, and follows with phone calls, sometimes the day of the meeting, to confirm a
quorum will be present. The staff liaisons to the Arts and Culture Commission and
Public Art Committee will make phone calls prior to their meetings if they have become
aware of the possibility of a member being absent, as they do not routinely have a full
complement on either of these policy bodies, and may not have a quorum to conduct a
meeting if others will be absent.
Other policy bodies have no particular issue with attendance and staff isn’t charged with
continually contacting their membership to ensure a full body will be present at regular
meetings.
Attendance standards of other agencies
In review of attendance standards of various cities throughout the county there are a
number of attendance procedures that can be adapted to Gilroy. Some highlights
gleaned from other cities are items such as use of a single uniform attendance policy for
all policy bodies to follow; a procedure of reporting absences; providing definitions of
excused absence and emergency absence; and incorporation of a maximum
percentage of meetings that can be missed.
Attendance Policy
Developing a policy with reporting processes and definitions of excused, unexcused and
emergency absences will support our policy bodies in maintaining a quorum by
establishing clear guidelines that must be followed .
Reporting
On average the majority of cities surveyed require that absences be reported to staff
within 72 hours of the meeting to be deemed excused and emergency absences are to
be reported within 24 hours of the meeting.
Definitions
Options for excused absences are: an illness of the member or their parent, spouse or
domestic partner, dependent children or other dependent, and a work related obligation
requiring the member to be away.
Emergency absence options are hospitalization or accident of the member or their
parent, spouse or domestic partner, dependent children or other dependent.

Another option found was to incorporate a maximum percent of meetings that can be
missed. Examples were no more than twenty percent of the total number of regular
meetings in a calendar year. This option would conflict with the Charter which clearly
defines absence determination at 3 consecutive unexcused absences.
CONCLUSION
As our Charter identifies the particular guidelines for removal from office due to
absences, at 3 consecutive unexcused absences, guidelines identifying excused and
emergency absences and creating specific steps in reporting absences, both
emergency and otherwise, can be implemented uniformly for all our 15 boards and
commissions to assist in maintaining a quorum at these meetings.
NEXT STEPS
If the Council chooses to move forward with creating uniform attendance standards for
all boards and commission, a policy establishing rules for attendance will be presented
to Council for consideration.
