BACKGROUND The City conducted a sixteen-week recruitment period prior to the summer break and through the beginning of the school year to fill six seats on the Youth Commission for 2-year terms ending 9/20/2020. We partnered with the Gilroy Unified School District Public Information Office to distribute the recruitment material to all Junior High and High School Principals, as well as through GUSD Twitter, Facebook and E-newsletters. W e also published the open recruitment in our activity guide and promoted the recruitment efforts through all of our social media outlets and the City website. Recreation staff took extra efforts to conduct outreach at the Gilroy Youth Center, Late Night Gym, San Ysidro Park and at special community events such as our A Packet Pg. 7 Party in the Park and National Night Out events as well as with parent organization San Ysidro Nueva Vida from east Gilroy. 19 applications were received for Council interview. Due to lack of opportunities, some youth in Gilroy look to finding things to do but often times they are not smart things. If you are appointed, what are the steps you will take to address this problem? Some of the biggest problems facing youth in Gilroy are gangs, drugs, gun violence, and violence in general. At school, I hold the position of President of the Yearbook Club. Currently, I am also ASB Vice President of GECA. Last year, I was also apart of the tutoring program at GECA, so I would help each grade level in any subject they were having trouble with. Throughout the five years that I have lived here, I have helped in the senior center that is close to the library. In regards to the library, I have also been able to help there as well. I go to church here in gilroy and I enjoy being able to give my time to volunteering with children at my church. Not exactly in Gilroy, but I do have prior experience working with organizations and groups. When I was living in San Diego, I helped out during the week at an organization for children. We would teach kids about the Gospel and give them different life lessons. At the same time, because they were children, we would add in some fun activities to the mix. At the moment, I am working with the Leukemia and Lymphoma Society with a subdivision that they have called Students of the Year. It’s this amazing program where I will be able to raise money for children and teens who are going through blood cancer. All the money that is raised will go into research for blood cancer and therapies for the kids who are going through this right now. I am meeting with people and business to acquire fundraisers, sponsorships, or some type of help to raise money for the children with blood cancer. I am having meeting and talking to people, asking for help to make sure I am able to have a great fundraiser. My ultimate goal is to raise $23,000 towards the foundation. Why would you like to be appointed to the Gilroy Youth Commission? I would like to be appointed to the Gilroy Youth Commission because I believe I will be able to help in giving insight to the teen issues that are happening around me. Before, I never knew that there was such a commission where issues facing teens could be talked about and resolved in some way, but I know about it now. Being around these problems, I have first hand knowledge about what is going on around me and what is happening with the teens around me. I don’t just want to be the person who gossips about other people's problems or who just makes matters worse, I want to help solve the issues and hopefully help some people make their life better than before. I want to be the voice for those who feel as through they don’t have the power to do it themselves. I want to be the one to listen to their matters and to let them know that such things can be fixed if I am allowed to do so. I don’t think anyone should be brought down by an issue that could have been solved or prevented. I want to be appointed because I want to be able to help the youth of gilroy with any problems that could be surfacing up by showing them that there are people who are here to help them. If you are appointed, what are the steps you will take to address this problem? I believe the biggest problem facing the youth of Gilroy is drugs. I think with the whole glorification of it seen in movies, teens think it’s okay to do it and a great experience. Another thing is when you see movies of people who go into high school or who go off to college, there is a scene where someone throws a party and everyone either gets high on drugs or is intoxicated. They glorify this act so then teens assume it’s okay and want to try it soon, but what they don’t understand is the severe negatives that come with doing so. With the legalization of weed, teens might assume that it’s okay to have such drugs in your possession and to even take those drugs from time to time. I think teens should be taught the negative outcomes that come with taking drugs that way they are more cautious of the decisions they make and understand the effects they are making on their life. If I were appointed, the steps I would take to address this problem would be to make flyers, addressing the issue and the alternative routes you should take, and I’d post them around not just high school, but middle school campus to make it be known that this is a problem happening in most school campuses. I think it would also be a good idea to go and visit middle schools and high schools and talk to them about the dangers of taking drugs. Two years ago, while I was at GECA, a women who worked with kids to try to help them with their drug problems, came to my school and talked to us about how drugs can affect you and the issues behind it. She came to my school and talked about what causes someone to go to the measures of taking drugs and the things we should do instead. That is a step I would like to take to address the issues surrounding drugs. In order to do this, I would first talk to my GECA principle and ask her how and where I could find the women that taught us those lessons. Then, once I have been given that information, I would go meet with her and talk to her about giving her message to other high schools and middle schools in the area. If she agrees, and I hope she does, I would meet up with the principles of the high schools and middle schools here in gilroy to let them know about the program and how it would be beneficial to the school environment and students. If the school officials say yes to doing the program, I would then give them the information, such as the women's phone number and what she does, and let them call the program so they can finalize and set up how they will work this into their schedule. Before I became apart of the youth commission, I didn’t really understand what the youth commission really did for the city or what it’s role was. I only understand the basic information based on the flyer about the Youth Commission and the website, but I didn’t know what programs they were apart of or what they had the power of doing. I think it’s great that we have the commission to help do this, but I think getting information from teens outside of the commission is also helpful. However, the problem with that is that most people don’t even know what the Youth Commission is or does, and they don’t know when they meet or if they can even be apart of the meetings. I would improve my previous performance on the Commission by announcing to my friends, classmates, and other teens about the what the youth commission is and how they can help, even if they are not a member. Also, I would let them know what days the Youth Commission has meetings and when they can come to the meetings. That way, we are able to gain even more perspectives and new ideas. The biggest issue that youth are currently facing in Gilroy is their lack of interest in education. Many youth don’t understand that education is important and that once they fall behind it is very hard for them to be able to catch up. There are also some youth that are trying their best to improve but don’t get the right help to be able to succeed. More empowering youth programming is needed for youth to be able to believe that they can do more. One of the biggest problems that I believe is facing the youth of Gilroy is poverty. An example of this, is at my school when the teachers prepare to hand out PE clothes for the year they mentioned a paper that students can fill out if their parents can't afford to pay the fee. This fact made me understand just how real poverty is. The cost for PE clothes is 30 dollars per pair (shirt and shorts) and to some that may seem like a small amount of money. For the past two years I have been volunteering in the Yellow Parking Lot. I am a leader in the lot and am given a walkie talkie to communicate with the Headquarters and other leads. I usually work the busy intersections for parking and I enjoy making sure that the lot runs smoothly for those visiting our Festival. This year I worked from open to close all three days. I enjoy knowing that I am helping my community by helping visitors get into and out of the lot efficiently. I would like to be appointed to the Gilroy Youth Commission so I can be a part of something bigger in my community. I like that if I were appointed, I would be discussing and coming up with ways to positively affect the youth of my community. I feel one of the biggest problems facing the kids my age is a lack of free, educational activities. I remember going to every Kids Discover Art when I was younger, but the age cutoff was age 10. 1 would like to see an Art or Science Fair put on twice a year in Gilroy that would target kids over the age of 10. 1 would like to do advertising so we get a bunch of kids to come, and offer hands on activities that show how science and learning can be fun. EXECUTIVE SUMMARY A recent review of our City code by the Bureau of Gambling Control discovered conflicting language in regard to wager limits. In one section, the City code states there shall be no limits on any single ante, wager, or bet. The code later states that no person is permitted to make a single ante, wager or bet in excess of two hundred dollars ($200.00). The Bureau of Gambling Control found this language to be contradictory and recommended the City code be updated to reflect the correct wagering allowance. BACKGROUND 9.A Packet Pg. 66 In 2006, the passage of SB 1198 allowed local jurisdictions that permit legalized gambling in cardrooms to authorize "no limit" wagers in their local gambling ordina nces. Specifically, the bill removed wagering limits from the definition of "expansion of gambling" in the Gambling Control Act and exempted wagering limits from the moratorium on gambling expansion. The bill also removed the requirement that increases in wagering limits be approved by local voters. This bill became effective on January 1, 2007. Most of the local jurisdictions in this area have followed suit allowing removal of a set limit and authorizing the betting limit to be that allowed under State law, which is unlimited. Cardrooms shall establish wagering limits in accordance with such limitations. On March 4, 2013, the Gilroy Council passed and adopted Ordinance No. 2013 -05 amending Chapter 16.6-1 pertaining to cardrooms. The amendment was in response to a request from the Garlic City Cardroom to amend the chapter to establish new unlimited wagering in accordance with that set by the State of California. The betting limit at the time was $200 per bet. Council approved a one year trial period for unlimited betting, commencing April 3, 2013. The amendment to section 16.6-1 (s) (1) of the Gilroy City Code reads as follows: (s) Wagers. There shall be no limits on any person playing within the cardroom premises to make a single ante, wager or bet. (1) There shall be a trial period of one (1) year commencing on April 3, 2013. The chief of police will monitor the cardrooms for any adverse impacts during the trial period, and report back to the city council no later than the end of the trial period. After consideration of the recommendation and findings of the chief of police, the city council may accept the report, resulting in the no limit on single antes, wagers or bets to continue, and the one (1) year trial period to be no longer in effect. The ordinance also defines wagering limits in Section 16.6-1 (x) (3) as follows: (3) No person playing a game upon the cardroom premises is permitted to make a single ante, wager or bet in excess of two hundred dollars ($200.00); In a subsequent staff report related to a request to increase the table limit, dated May 2, 2016, it re-addresses the issue of no limit wagers. The staff report states, “Council also approved the designation of the Chief of Police as the City Official to approve games and the elimination of unlimited wagering with a sunset of one year from the adoption of the ordinance.” The staff report continued, “The Chief of Police reported no adverse impacts to the City as a result of Councils’ approval of unlimited wagering.” ANALYSIS The proposed amendment to Gilroy City Code Section 16.6-1 were sent to the Bureau of Gambling Control on May 29, 2018 for review prior to the submission of this staff report. On July 3, 2018, the City received a letter from the Bureau of Gambling Control stating that it did not object to unlimited wagering limits or the play of all games permitted by local, state, and federal law, at the Garlic City Cardroom. 9.A Packet Pg. 67 During the trial period, there were no adverse effects from unlimited wagering. The general consensus is that a no limit game not only provides for a greater opportunity for strategic play, but allows the participants to win larger sums of money and conversely could result in larger losses. A majority of cardrooms in California allow no limit games. CONCLUSION The Council introduced this ordinance at the September 10, 2018 meet ing with a 6-0 vote. ANALYSIS The proposed additions to the BPC roles and responsibilities reflect similar roles and responsibilities vested upon other City Boards and Commissions. By becoming involved in the CIP review process and in policy recommendations for bicycle and pedestrian facilities, the BPC can provide guidance to the City Council early in the process, bringing into focus recommendations that ensure future development considers bicycle and pedestrian safety and mobility along with compliance with the City’s Complete Streets Policy (Resolution No. 2012 - 46). FISCAL IMPACT/FUNDING SOURCE There is no fiscal impact or budget action necessary as a result of the recommended action. CONCLUSION As directed by Council, an ordinance amending the roles and responsibilities of the Bicycle Pedestrian Commission has been prepared for introduction. This MOU covers thirty-five (35) employees in the classifications of Fire Captain, Fire Engineer, and Firefighter (Paramedic). The main areas of change for the IAFF, Local 2805 MOU are summarized below: Two year contract (July 1, 2018 – June 30, 2020). 10.B Packet Pg. 80 Salary increases as follows: o 3.5% effective 7/1/2018 o 3.5% effective 7/1/2019 Continue the current cost share program for health care; 5% increase to the city contribution toward medical and dental allotment; employee picks up any remaining cost for medical and dental insurance premiums. Implement Voluntary Employee Beneficiary Association (VEBA) plan focu sed on savings for retirement medical expenses with the city making a monthly contribution of $150.00 per month. Eliminate 24 hours of personal leave time off. Increase uniform allowance by $19.17 per month. Increase boot allowance by $100 for boots purchased every two years. Reduction in linen service costs. Increase tuition reimbursement from $750.00 per fiscal year to $1,000 per fiscal year for approved courses and programs per program requirements. Language updates for compliance with regulations and/or operational needs. A final copy of the MOU and the corresponding salary schedules are attached for Council’s review and approval. Staff worked with bargaining team members to prepare the changes to the MOU documents. The final draft of the MOU has been reviewed by representatives of the bargaining unit and a designated representative from the negotiating team has signed-off on the final document. The remaining members of the GPOA negotiations team and the City negotiations team will sign the document following Council approval. FISCAL IMPACT The FY 2019 cost to implement the above MOU salary and benefit changes is estimated to be approximately $322,300. There is an offset associated with the elimination of twenty-four (24) hours of personal leave time off per employee as this time off has an estimated value of approximately $60,680. In addition, the reduced linen service will have an annual savings of approximately $20,000. The FY 2020 cost to implement the salary increase noted above is estimated to be approximately $320,000 (cost plus reductions). The FY 2019 budget can absorb a portion of the cost to implement the MOU; however, additional funding in the amount of approximately $104,000 will be required and, 10.B Packet Pg. 81 therefore, additional appropriation will determined during the FY 19 mid-year budget review. It should be noted, that the Fire Department typically finishes the fiscal year well under their authorized appropriation level – it is reasonable to expect that the current budget will be able to absorb the FY 19 MOU impacts. The ongoing additional costs at the end of this agreement are approximately $512,000 annually – the City’s 10-year financial forecast includes 2% for general personnel cost increases, thus the difference will be incorporated into future budget recommendations brought to City Council for approval. BACKGROUND The purpose of these resolutions is to designate individuals, with their respective job titles, who are authorized to conduct financial transactions on behalf of the Gilroy Industrial Development Authority. Due to Finance Department changes, the title of Assistant Finance Director no longer exists and thus the prior resolution requires updating. ANALYSIS Board consent is required to establish appropriate designations of the individuals and/ or position titles who may perform financial transactions and investing activities on behalf of the Authority. BACKGROUND The purpose of this action is to rescind the previous resolution that authorized the use of the Local Agency Investment Fund (LAIF) and designated individuals, with their respective job titles, who are authorized to conduct financial transactions in administering Gilroy Industrial Development Authority (GIDA) investments in LAIF. In order to adjust the names and/or titles of authorized individuals, the Board must rescind the previous resolution in its entirety. ANALYSIS 11.B Packet Pg. 197 Due to changes in the Finance Department over the last few years, the title of Assistant Finance Director no longer exists and thus the prior resolution requires updating to reflect the current organization. The position titles with such authority will now include the City Administrator, Finance Director, and the Finance Manager (Accounting Division). The new resolutions will also provide for the successor of any of the specified positions to retain the established authority going forward since the resolution mentions the individual by position title. Adoption of the revised resolution would also continue the City’s long standing practice of utilizing LAIF – an investment vehicle that adheres to the City’s Investment Policy and is utilized by most California municipalities. ALTERNATIVES The Board could decide to not approve the revised resolution, however this is not recommended as it would leave an individual that is no longer employed with the City as an authorized signatory.
