III. APPROVAL OF MINUTES
A. January 7, 2010
Motion to Approve the minutes of January 7, 2010 as written. Moved by Vice Chair Ben Anderson,
seconded by Commissioner Ermelindo Puente.
IV. PRESENTATION BY MEMBERS OF THE PUBLIC
V. PUBLIC HEARINGS
A. Z 08-02 Zone Change to remove the restriction that a parcel located at the Southwest corner of
Santa Teresa Boulevard and Hecker Pass Highway remain an estate lot and to allow the development
of a 120-bed skilled nursing facility and an ambulatory surgery center, on property zone R3-PUD
(Medium Density Residential-Planned Unit Development). DMA Partners, LLC, applicants.
Motion to recommend approval to the City Council of the Mitigated Negative Declaration, with the 13
mitigated measures, finding that (a) it is completed in compliance with CEQA; (b) it reflects the
independent judgment of the City; and (c) there is no substantial evidence that the project will have
a significant effect on the environment. Moved by Commissioner Kai Lai, seconded by Vice Chair Ben
Anderson.

on the City property be temporarily maintained and the community garden be maintained and paid
for, in perpetuity, by the applicant or any subsequent owner. Moved by Commissioner Joan Spencer,
seconded by Commissioner Brad Bannister.

VII. NEW BUSINESS
A. AS 08-21 Architectural and Site request to allow the development of a skilled nursing facility and an
ambulatory surgery center on property zoned R3-PUD, located at the Southwest corner of Santa
Teresa Boulevard and Hecker Pass Highway. DMA Partners, LLC, applicants.
Motion to recommend approval of AS 08-21 to the City Council with the condition that the
landscaping on the City property be temporarily maintained and the community garden be
maintained and paid for, in perpetuity, by the property owner or any subsequent owner and with the
condition that the item come back to the Planning Commission regarding the plantings along Hecker
Pass Highway. Moved by Commissioner Joan Spencer, seconded by Commissioner Ermelindo Puente.
B. Agenda and Staff Report Recommendations
Motion to Approve formatting the agenda to show all possible actions as well as staff’s
recommendation. Moved by Commissioner Joan Spencer, seconded by Commissioner Brad Bannister.
