Motion to Approve the minutes of April 1, 2010 as written. Moved by Commissioner Ermelindo Puente,
seconded by Commissioner Thomas Boe.

A. CUP 10-01 Conditional Use Permit to allow the operation of an Adult Day Care Center, on property
zoned DED (Downtown Expansion District), located at 7101 Monterey Street. Susan Copley, applicant

Motion to prepare Resolution 2010-05 approving CUP 10-01 with the conditions as identified by staff.
Moved by Commissioner Thomas Boe, seconded by Commissioner Brad Bannister.
B. Z 07-05 Zone Change Map amendment to rezone a portion of 5.74 acres from CM (Commercial
Industrial) to C3-PUD (Shopping Center Commercial-Planned Unit Development), located at the
northeast corner of Leavesley Road and Forest Street. Fresh Group Inc., c/o Tauan Chen, applicant.

Motion to recommend approval of the Mitigated Negative Declaration, finding that (a) it is completed
in compliance with CEQA; (b) it reflects the independent judgment of the City; and, (c) there is no
substantial evidence that the project will have a significant effect on the environment with the
following changes:

Commissioner Kai Lai, seconded by Commissioner Thomas Boe.
C. AS 08-01 Architectural and Site request to construct two (2) hotels, two (2) restaurants, and a
parking structure located at the northeast corner of Leavesley Road and Forest Street. Fresh Group Inc.,
c/o Huamin Chang, applicant.

Motion to recommend City Council approve AS 08-01 with the conditions as written but with the
following changes:
D. Z 10-03 Zoning Ordinance Text Amendment of Section 50.62 and 50.63 of the Zoning Ordinance to
provide additional circumstances under which residential projects may receive building allotments, to
establish and clarify processes for award of allocations and to correct minor text errors. City of Gilroy,
applicant.
Item VI.D. Z 10-03 ZO Text Amendment
Motion to prepare Resolution 2010-07 recommending City Council approve Z 10-03 with the following
changes: the text of item four be changed to read that "Property must be considered an infill project by
the Planning Commission and City Council." and in the policy recommendation item one, establish a
quarterly opportunity for the City Council to review available RDO units. Moved by Commissioner
Thomas Boe, seconded by Commissioner Ermelindo Puente.
