October 7, 2010 Item III.A. - Minutes of October 7, 2010 Motion to Approve the minutes of October 7, 2010 as written Moved by Commissioner Joan Spencer, seconded by Vice Chair Ben Anderson. IV. PRESENTATION BY MEMBERS OF THE PUBLIC V. PUBLIC HEARINGS A. CUP 10-02 Conditional Use Permit request to allow the expansion of a non-conforming use up to 25 percent, on property zoned CM (Commercial Industrial), located at 7250 Alexander Street. Item V.A. - CUP 10-02 Motion to deny CUP 10-02 to allow for a 25 percent increase of floor area to a non-conforming, single family residence pursuant to Section 48.22 of the Zoning Ordinance, due to the inabililty to make finding B as the increase would adversely affect other property in the vicinity because of setbacks on the northeast corner of the building as the CUP was presented. Moved by Vice Chair Ben Anderson, seconded by Chair Jim Gailey. Motion to continue CUP 10-02 to the Planning Commission meeting in December. V 10-03 Variance request from Zoning Ordinance Section 31.25 (b) Downtown Specific Plan Parking Requirements, to allow the reduction in required parking, on property zoned DED (Downtown Expansion District), located at 66 Third Street. Item V.B. - V 10-03 Motion to prepare Resolution 2010-12 approving the application for Variance 10-03 making the required findings and with the four conditions of approval in the staff report. Moved by Commissioner Joan Spencer, seconded by Commissioner Brad Bannister. C. TM 10-02 Tentative Map request to create 7-residential and 2-commercial condominiums on property zoned DED (Downtown Expansion District), located at 66 Third Street. Barbara Seiler, applicant. Item V.C. - TM 10-02 Motion to recommend City Council approve TM 10-02 to include the 47 conditions listed in the staff report. Moved by Commissioner Joan Spencer, seconded by Commissioner Brad Bannister. D. RDO-HE 10-03 Residential Development Housing Exemption to request the allocation of 41- residential units under Zoning Ordinance Section 50.62 (b) (11), on property zoned R1 (Single Family Residential), located west of Santa Teresa Boulevard, south of Sprig Way.
