III. APPROVAL OF MINUTES
A. November 5, 2009
Motion to Approve the minutes of November 5, 2009 as written. Moved by Commissioner Joan
Spencer, seconded by Commissioner Ben Anderson.
IV. PRESENTATION BY MEMBERS OF THE PUBLIC
V. PUBLIC HEARINGS
A. CUP 09-04 Conditional Use Permit to allow offices on the first floor of a commercial building located
at 7680 Monterey Road, on property zone DHD (Downtown Historic District. Almeida Construction [c/o
Afonso Almeida], applicant.
Motion to Approve the preparation of resolution 2009-07 approving CUP 09-04 subject to the revised
condition presented by staff to the Planning Commission and which approval supersedes the
limitations stated in condition number one imposed on CUP 04-08 dated February 3, 2005. Moved by
Commissioner Joan Spencer, seconded by Vice Chair Art Barron, Sr..
B. CUP 03-06 Conditional Use Permit update to allow 100-students in grades preschool through 8th
grade, in an existing church located at 8095 Kelton Drive on property zoned C3 (Shopping Center
Commercial). Monterey Road. South Valley Church [c/o Bob Costamagna], applicant.
Motion to Approve the preparation of resolution 2009-08 approving the amendment of CUP 03-06
subject to the four conditions outlined in the staff report and with the inclusion of condition one from
the original approval of CUP 03-06; that mitigation measure shall be modified by removing the word
"middle" from sentence one and striking the last sentence completely. Moved by Commissioner Joan
Spencer, seconded by Vice Chair Art Barron, Sr..
