Motion to approve Moved by Commissioner Joan Spenser, seconded by Commissioner Brad Bannister.

V. PUBLIC HEARINGS:
A. V 09-02 Variance request from Zoning Ordinance section 19.23 (b) to allow a reduced side-yard
setback on property zoned GD (Gateway District) located at 6620 Monterey Road. Hydroturf [c/o Jack
Aliotti], applicant.
Motion to Approve preparing resolution #2009-06 approving V 09-02 subject to the four conditions of
approval as detailed in the staff report and declaring V 09-01 to be null and void. Moved by Chair
Thomas Boe, seconded by Commissioner Brad Bannister.
B. USA 00-02 Urban Service Area amendment request to include approximately 48 acres of land
located South of Vickery Avenue, East of Kern Avenue, and West of Wren Avenue into the City of
Gilroy's Urban Service Area Boundary Wren Investors [c/o Skip Spering], applicant.
Motion to Approve continuing USA 00-02 to the September 17, 2009 Planning Commission meeting
at 6:30 p.m. Moved by Vice Chair Art Barron, Sr., seconded by Commissioner Joan Spenser.
C. USA 07-01 Urban Service Area amendment request to include approximately 284.7 acres of land
located north of Hecker Pass and north & east of Burchell Road into the City of Gilroy's Urban Service
Area Boundary. Lucky Day Partnership [c/o John Vidovich], applicant.
Motion to Approve continuing USA 07-01 to a September 17, 2009 Planning Commission meeting at
6:30 p.m. Moved by Vice Chair Art Barron, Sr., seconded by Commissioner Joan Spenser.
D. USA 08-03 Urban Service Area amendment request to include approximately 294 acres of land
located north of Santa Teresa Boulevard, south and east of Thomas Road and west of Monterey Road
into the City of Gilroy's Urban Service Area Boundary. Shapell Industries [c/o Susan Mineta],
applicant.
Motion to Approve continuing USA 08-03 to the September 17, 2009 Planning Commission meeting
at 6:30 p.m. Moved by Vice Chair Art Barron, Sr., seconded by Commissioner Joan Spenser.
E. USA 08-02 Urban Service Area amendment request to include approximately 148 acres of land
located at 5055 Santa Teresa Boulevard. (Gavilan College) into the City of Gilroy's Urban Service Area
Boundary. Gavilan College [c/o Steve Kinsella], applicant.
1. APPLICATION WITHDRAWN AS OF AUGUST 20, 2009.
