September 3, 2009 Motion to Approve minutes from the September 3, 2009 meeting as written. Moved by Commissioner Ben Anderson, seconded by Commissioner Joan Spencer. IV. PRESENTATION BY MEMBERS OF THE PUBLIC V. PUBLIC HEARINGS VI. OLD BUSINESS: A. USA 07-01 Urban Service Area amendment request to include approximately 284.7 acres of land located north of Hecker Pass and north & east of Burchell Road into the City of Gilroy's Urban Service Area Boundary. Lucky Day Partnership [c/o John Vidovich], applicant. Motion to Approve finding the Lucky Day Final SEIR to the Gilroy General Plan complete and in compliance with CEQA and recommending that it be certified by Council. Moved by Commissioner Ben Anderson, seconded by Commissioner Ermelindo Puente. Motion to Approve USA 07-01 including the Lucky Day USA amendment site into the Urban Service area. Moved by Commissioner Ben Anderson, seconded by Commissioner Ermelindo Puente. B. USA 08-03 Urban Service Area amendment request to include approximately 294 acres of land located north of Santa Teresa Boulevard, south and east of Thomas Road and west of Monterey Road into the City of Gilroy's Urban Service Area Boundary. Shapell Industries [c/o Susan Mineta], applicant. Motion to Approve finding the Thomas Neighborhood District and Gilroy Sports Park Addendum to the Gilroy General Plan EIR complete and in compliance with CEQA and recommending that it be certified by Council. Moved by Commissioner Joan Spencer, seconded by Commissioner Ermelindo Puente. Motion to Approve USA 08-03 including the Thomas Neighborhood District and Gilroy Sports Park USA amendment site into the Urban Service Area. Moved by Commissioner Joan Spencer, seconded by Commissioner Ermelindo Puente. C. USA 00-02 Urban Service Area amendment request to include approximately 48 acres of land located South of Vickery Avenue, East of Kern Avenue, and West of Wren Avenue into the City of Gilroy's Urban Service Area Boundary. Wren Investors [c/o Skip Spering], applicant. Motion to Approve finding the Wren Investors Final SEIR to the Gilroy General Plan EIR complete and in compliance with CEQA and recommending that it be certified by Council. Moved by Commissioner Ben Anderson, seconded by Commissioner Ermelindo Puente. Motion to Approve USA 00-02 including the Wren Investors USA amendment site into the Urban Service Area. M 09-02 Interpretation of Zoning Ordinance section 19.13 (b), "Commercial Use Table (Downtown Specific Plan Districts)" to determine if car stereo sales and installation would be classified as a retail establishment that may be permitted in the Downtown zoning districts. City of Gilroy [c/o Melissa Durkin], applicant. Motion to Approve M 09-02 interpreting Section 19.13 (b) of the Zoning Ordinance to include car stereo sales and installation under the category of Automotive Sales on the Commercial Use Table with the conditions that sales are limited to car stereos and alarm systems and their installation and service must take place indoors.
