City Clerk's Report on Posting the Agenda Interim City Clerk, Beth Minor advised the agenda was posted on Friday, January 24, 2025 at 4:43 P.M. 1.5. PUBLIC COMMENT BY MEMBERS OF THE PUBLIC ON ITEMS NOT ON THE AGENDA BUT WITHIN THE SUBJECT MATTER JURISDICTION OF THE CITY COUNCIL Carol Parks expressed gratitude to the Gilroy Police Department for their commitment to Public Safety. She noted her concerns regarding the City’s immigration policy and how it was City Council Regular Meeting Agenda January 27, 2025 | 6:00 PM Page 2 of 6 communicated to the public. Ron Kirkish spoke regarding a social media post by Council Member Hilton regarding U.S. Immigration and Customs Enforcement of illegal immigrants. Gary Walton spoke about his frustrations with the City and trying to get a Downtown project completed. Elia Salinas spoke regarding public safety contract negotiations, Council Member Hilton’s social media post, and the accolades given to the retiring employees and the members of the public. 5. REPORTS OF COUNCIL MEMBERS Council Member Bracco No report. Council Member Fugazzi noted he attended his first Visit Gilroy California Welcome Center meeting and spoke about the services they provide to the public, as well as items they have for sale. Council Member Marques recapped her meeting with the Santa Clara Valley Habitat Agency Governing Board where the discussion centered on their 2024 budget. Council Member Hilton noted the membership of and the policy issues the CalTrain Policy Group was working on. He spoke regarding the increase in ridership on VTA, and the Silicon Valley Clean Energy Authority and their role in electricity within the County. Council Member Ramirez spoke regarding her first Gilroy Sister Cities meeting. She noted they are looking for an adult female between 18 and 24 years of age to represent Gilroy to attend a festival in the City of Angra, Azores, Portugal, this summer. Council Member Cline No report. Mayor Bozzo stated the Gilroy Gardens Board of Directors elected Dan Harney as their new Chairman of the Board 6. BOARD AND COMMISSION INTERVIEWS 6.1. CONSENT CALENDAR 7.1. Approval of the Action Minutes of the January 6, 2025 City Council Regular Meeting as verbally amended by Interim City Clerk, Beth Minor. 7.2. Approve the Donation of Maui, a Trained Therapy Dog from the Leadership Gilroy Class of 2024. Mayor Bozzo requested to pull this item so Maui could be introduced, Council unanimously voted to pull this item. 7.3. Adoption of an Ordinance Approving the First Amendment to the Development Agreement Between the City of Gilroy and Glen Loma Corporation for the Glen Loma Ranch Project to Extend the Term of the Development Agreement by Three Years Enactment No.: Ordinance No. 2025-01 7.4. Adopt a Resolution Amending Resolution No. 2023-27 to Reduce the Number of Council Members Serving on the Downtown Committee. Enactment No.: Resolution No. 2025-02 Mayor Bozzo opened Public Comment. Award a Three-Year Contract to Secure Guard Security Services in a Total Amount of $233,451 with an Annual Not-to- Exceed Amount of $77,817 for Park Patrol Security Services, with Up to Two, One-Year Extension Options This item has been continued to the February 3, 2025 meeting. 8.2. Award a Contract to Apex Companies for the FY25 Installation of Small Trash Capture Devices Project No. 25-PW-293 in the amount of $189,800; Approve a Budget Amendment; Approve a Project Contingency of $60,200; Approve a Total Project Expenditure of $250,000 for Construction; and Adopt a Resolution Amending the Fiscal Year 2025 Budget Mayor Bozzo opened Public Comment. There being no speakers, Mayor Bozzo closed Public Comment. 11. INTRODUCTION OF NEW BUSINESS 11.1. 2025 City Administrator Performance Evaluation Process Mayor Bozzo opened Public Comment. Ron Kirkish noted he felt the evaluation should include employee morale. There being no further speakers, Mayor Bozzo closed Public Comment. MOTON: To appoint Mayor Bozzo, and Council Members Cline and Ramirez to a three-member Council sub-Committee for the City Administrator Performance Evaluation Process. MOTION: To approve the purchase of the Vehicle Incursion Barrier Systems from Meridian Rapid Defense Group for a total of $295,682.11. CITY ADMINISTRATOR'S REPORTS City Administrator, Jimmy Forbis spoke about the 8th St. & Alexander Street housing project and that it is part of the Santa Clara County Bond Measure. He also provided an update to the new Santa Teresa Fire Station. Additionally, Union Pacific Railroad is in the process of clearing out the homeless encampment along 9th St. and Alexander. City Council Regular Meeting Agenda January 27, 2025 | 6:00 PM Page 6 of 6 14. CITY ATTORNEY'S REPORTS City Attorney, Andy Faber advised he had nothing to report. He read the Closed Session title into the record. 15. CLOSED SESSION 15.1. CONFERENCE WITH LEGAL COUNSEL - PENDING LITIGATION. Pending Litigation Pursuant to Paragraph (1) of Subdivision (d) of Government Code Section 54956.9 and Gilroy City Code Section 17A.11 (3) (a), Gandolfi Investments, LLC v. City of Gilroy, et.al., Superior Court for the County of Santa Clara, Case Number 24CV444165, filed July 26, 2024. Upon receiving advice from the City Attorney that to discuss the matter in open session would prejudice the position of the City in the litigation, the Council voted unanimously to enter closed session. The City Council unanimously voted to go into the Closed Session. When in the Closed Session the City Council voted to stay in the Closed Session. 16. ADJOURN TO OPEN SESSION Upon returning to open session, the City Attorney announced there was no reportable action. 17. ADJOURNMENT The meeting was adjourned at 9:05 P.M.
